"~t:~e;~Et~:~~lJ~~~CD1;~~~~r <br /> <br />April 14, 2008 <br /> <br />SUBJECT <br />Environmental Oversight Agreement for the Bradford parcels with the State Department <br />of Toxic and Substance Control <br /> <br />RECOMMENDATION <br />Approve the Resolution to enter into an Environmental Oversight Agreement with the <br />State Department of Toxic and Substance Control Board in an amount not to exceed <br />$18.100 for the Bradford parcels. <br /> <br />BACKGROUND <br />The Redevelopment Agency (Agency) is requesting that the California Environmental <br />Protection Agency's Department of Toxic and Substance Control (DTSC) be the <br />oversight organization for the remediation of four Agency and City owned parcels on <br />Bradford Street near Main Street. The Environmental Oversight Agreement (EOA) , <br />available only for redevelopment agencies, will be used to receive a closure letter and <br />obtain liability relief under the Polanco Redevelopment Act.1 The EOA establishes a <br />collaborative clean up process between DTSC and the Agency to facilitate timely and <br />cost-efficient remediation that is beneficial to expediting the clean up process. <br /> <br />As shown in the attached EOA, the first section is the form agreement containing the <br />basic business provisions, including a framework for reimbursement of DTSC's <br />oversight costs. The second section is the scope of work, followed by a schedule and <br />standard provisions. <br /> <br />The Agency has been continually seeking opportunity sites to increase, improve and <br />preserve the supply of low and moderate income housing in Redwood City. In August <br />2004, the Agency purchased assessor parcel number (APN) 052-037-020 (707 <br />Bradford Street). In November 2006. the Agency bought the adjacent undeveloped <br />parcel, APN 052-037-017 (777 Bradford Street). These two parcels, combined with two <br />abutting City owned undeveloped parcels - APN 052-372-240 and 052-372-999 would <br />provide a contiguous area of approximately one acre to develop an affordable senior <br />housing with possible childcare project. <br /> <br />As part of its due diligence, the Agency prepared a Phase I Environmental Site <br />Assessment in June 2004 to gain a preliminary understanding of potential site <br />contamination by reviewing existing information. The Phase I report warranted a Phase <br />II Environmental Site Assessment consisting of subsurface investigation of soil and <br />water in areas where fill material was suspected to have been used (former Redwood <br /> <br />I The Polanco Redevelopment Act (Health and Safety Code Section 33459) assist redevelopment agencies in <br />responding to brownfields properties in their redevelopment areas by: 1) prescribing processes for redevelopment <br />agencies to follow when cleaning up a hazardous substance release in a redevelopment project area, and 2) <br />providing immunity from liability for redevelopment agencies and subsequent property purchasers for sites cleaned <br />up under a cleanup plan approved by DTSC or a Regional Water Board. <br />
