01/11/2021 RESOLUTION NO. 15929 RESOLUTION OF NOTICE OF INTENT TO VACATE PUBLIC, RIGHT- OF-WAY BEING A PORTION OF MAPLE STREET, IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, on May 7, 2018, the City Council of the City of Redwood City ("City Council") approved a 131 -unit townhouse development at 1548 Maple Street (the "Project"), and on May 21, 2018, the City Council adopted an ordinance approving a Development Agreement ("DA") between the City of Redwood City and the developer, Strada Investment Group, as part of the Project; and WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of Division 9 of the California Streets and Highways Code, the City Council hereby declares its intention to vacate the public right-of-way being a portion of Maple Street as shown on Parcel Map No. 91 - 10 in Book 67 of Parcel Maps, at Pages 26-27, in the office of the Recorder for the County of San Mateo, referred to in the DA as the "Maple Street Vacation Area," and as set forth in Exhibit 1, attached hereto and incorporated by reference; and WHEREAS, the DA, having been recorded in the official records of San Mateo County on November 15, 2018 as Document No. 2018-088890, provides that the vacation of the public right-of-way is subject to the dedication of a public right-of-way and public service easement, referred to in the DA as the "Blomquist — Developer Segment," and as set forth in Exhibit 2, attached hereto and incorporated by reference; and WHEREAS, pursuant to said provisions of the California Streets and Highways Code, notice of intention to vacate the herein described public right-of-way shall be published and posted in substantially the form attached hereto as Exhibit 3 ("Public Hearing Notice"), and incorporated by reference, and which includes a map or plan that shows the area intended to be vacated; and WHEREAS, a noticed public hearing on the question of vacating the public utility easement, as described below, shall be held and evidence thereon received by the City Council on February 8, 2021. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: Section 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety.
