6.E. - Page 2 of 12 <br />Argent Materials, Inc. ("Argent"), a subcontractor of Seton's on the Project, contends that it is owed <br />payment by SPC and United for materials supplied to the Project. On or about February 26, 2020, Argent <br />filed a stop payment notice with the City. On or about October 5, 2020, Argent commenced an action in <br />the San Mateo Superior Court, entitled Argent Materials, Inc. v. Seton Pacific Construction, Inc., et al., Civil <br />Case No. 20 -CIV -04322 to enforce its stop payment notice, naming Seton, United and the City as <br />defendants. <br />ANALYSIS <br />The City Attorney's Office recommends approval of the settlement as delineated in the attached <br />Settlement and Release Agreement. <br />FISCAL IMPACT <br />The settlement of One Hundred Fifty -Six Thousand Seven Hundred Fourteen Dollars and Sixty Cents <br />($156,714.60) are funds drawn from the Rule 20 Middlefield Road Utility Undergrounding project in the <br />Transportation Grants Fund.
