6.1 G <br /> Page 5 <br /> ATTACHMENT 2 <br /> 1.1 Lessar hereby grants to Lessee a lease far use of the premise consis#ing of one- <br /> 14'-42" x 13'-29" (19'1.6 square feet) enclosed area for Lease Area 2B subjecf to <br /> the agreements, co�ditions and provisions set forth in this Agreement. Lessee <br /> acknowledges that it will be accepting fhe Premises in its comp{eted condition <br /> per building pians that were completed by FMG Architects, Bid Sets, February <br /> 10, 2006 ("Bid Sets"}. Said Bid Sets have been reviewed by Lessee, and are <br /> incorporated herein by this reference. Lessee shall have the right to measure the <br /> siie of the Lease Area to insure size accuracy. The Lease provisions may be <br /> adjusted accQrding to such measurements prior to the execution of the Lease. <br /> 1.2 Lessee acknowledges that it recognEzes the uniqueness of the premises and <br /> accepts them in their current and disclosed condition existing on the date of <br /> execution of fhis Agreement, subject ta all applicable zoning, munic�paf, county, <br /> or state faws, ordinances and regulations affecting the use of the Premises. <br /> Lessee acknowEedges that it has satisfied itsel#, by its own independent <br /> investigation that the Premises are suitable for its in#ended use and neither <br /> Lessar nor its agents or representatives hav� made any representation or <br /> war�anty as to the present or future suitability of the Premises for fhe conduct of <br /> Lessee's business. <br /> 2. LEASE PERiOD <br /> 2.1 Term. The term of this Agreement shall be month-#o-month commencing upon <br /> the date ofi the lease execution day (Lease Commencsmen# Date), and ending <br /> upon receipt of 30 day termination notice from the Agency. if Lessor enters into <br /> a �ease Agreement with a longer term tenant for Lease Area 2B, Lessof shall <br /> provide Nancy Radcliffe witt� notice informing of such new tease and License <br /> agreements. The notice shall inform Nancy Radcliffe that she must cease <br /> operations on the Premises within 30 calendar days, or such other greater time <br /> period that is acceptable to the Agency. The notice shall relate that Nancy <br /> Radcliffe shalE have the option to either relocate to an available paviiion space, if <br /> avaiiable, or terminate this lease at the expiration of the 30 calendar day time <br /> period. <br /> 2.2 Delay in Possession. On the Lease Cornmencement Date, Lessee shall take <br /> possession of the Premises. If Lessee's ability ta take possession by the date as <br /> set forth in #his provision is delayed as a resul#of any af the foliowing causes, the <br /> date for delivery shafl be postponed without penalty ta �essee for a period of time <br /> equivalent to the periad caused by such delay: <br /> (a} acts of Lessar, its agents, or employees; <br /> (b) acts af God which Lessee could not reasonably have foreseen or guarded <br /> against; <br /> (c) any strikes, boycatts or like abstructive actions by employees or labor <br /> organizations and which are beyond the contro! af Lessee and which <br /> cannot be reasonably overcome; or <br /> (d) restrictive regufations by the Federal Government which are enforced in <br /> connection with a national emergency. <br /> Atty/Agr/2008A33 2 <br /> 050508 <br />
