The electricity charge wiU <br /> be based on actual usage by the Lessee. The telephone/ Internet, cable hookup <br /> shali be arranged directly with fihe communicatians company. <br /> 7.4 interruption. Lessor shati not be liable #or any failure or interruption of any utility <br /> service being furnished ta the Lease Area, and no such faifut�e or interruption <br /> sha(I entitle Lessee to terminate this Lease. <br /> 7.5 7rash and Recvclina. Lessee is solely responsible for removing its waste and <br /> recycling generated as a result of its business operations. The waste and <br /> recycling area shall be ctesignated by the Lessar. <br /> 8. RETAlL SERVICE <br /> 8.1 Use of Lease Area. Lessee is an independent contractor under the business <br /> name Lufu's. for the operafion of selling bafteries, fi[m, disposable cameras, <br /> seasonaf inerchandise, aspirin, lozenges, gifts, novefties periodicais, fresh <br /> flowers and plants, candy, and gum only and for no other purpose without written <br /> approval by the Lessor. <br /> (a) Any significant product change shall be appraved by Lessor. Lessor shall <br /> not unreasonably withhold approval of requested changes except when <br /> the praposed product change will infringe, unfairly compete with, ar <br /> duplicate the offerings and/or safes of another Courthause Square <br /> Pavilion Lessee. <br /> 8.2 Lessee's Duties. Lessee shal[ hire an adequate number of persons in order to <br /> sel! praducfs in a prompt and timeiy manner under this Lease. <br /> 8.3 Pavment afi Lessee's Employees. Lessee shail pay alf persons hired as required <br /> by Eaw, including but not limited ta, income tax withhoVding and social security <br /> payments. No empioyee of Lessee shalE be deemed to be an employee of <br /> Lessor. <br /> 8.4 Quaiitv of P�oducts. All products and presentation shall be first class with the <br /> minimum s#andard being high quality food and service comparable to or <br /> exceeding thase of other similar businesses. The highest standard of cleanliness <br /> and sanitation on the premises shal! be maintained withaut exception. <br /> 8.5 Mana4ement of the Cancession Space. Lessee shafl manage the concession <br /> space as stated in Section 1.1 and a(I operations therein. <br /> 8.6 Hours of Operation.
