Lessee sha11 reduce, reuse, and recycEe materials in <br /> order to reduce the amount of waste sent to landfiils. <br /> 8.9 Custodiaf Services. Lessee wiN provide ail custodial services and day-to-day <br /> clean-up for the Lease Area. <br /> 9 USE AND T1ME OF USE <br /> 9.� Unless otherwise agreed to by Lessor in writing, the Premises tnay be used only <br /> by Lessee and Lessee's agents, customers, and contractors for the pu�poses <br /> stated herein. <br /> 9.2 Lessee agrees not to use or permit use of the Premises fflr any unlawful <br /> purpose, and nof to commit or permit any waste or nuisance in or about the <br /> Premises. Lessee will nat use Premises in a rnanner that increases the risk of <br /> fire, cost of fire insurance or improvements thereon. Lessee at hislher expense, <br /> shali keep the Premises in as good condition as it was at the beginning of the <br /> terms hareof, except damage occasioned by ordinary wear and tear. <br /> 9.3 Lessee shall not do or perrnit to be done anything in any manner which <br /> unreasonably disturbs the other Courthouse Square less�es, their smp�oyees, <br /> customers, and visitors to the Courthouse Square, or the occupants of <br /> neighboring praperty. Speaficalty, and without limiting the above, Lessee agrees <br /> not to cause any unreasonable adors, noise, vibration, power emissions or other <br /> item ta emanate fram the Premises. No materials or articles of any nature shall <br /> be stored outside any portian of the Leased area un{ess written permission is <br /> abtained from the Lessar. <br /> '10. LESSEE iMPROVEMENTS <br /> 10.1 A11 specifications, drawings, and plans for propased Lessee improvements shall <br /> be submitted to Lessor for review and approval prior to the construction of said <br /> propased Lessee improvements. On the Lease Commencement Date, Lessee at <br /> his or her expense may begin to cQnstruct Lessee improvements to the Lease <br /> Area, but only if, a building permit and all othe� required permits are issued by <br /> the Lessar and insurance documents are provided to and approved by the <br /> Lessar, and the improvements are supervised by the Lessor or its agents. <br /> 10.2 The Lessor or approved agents shall be prpvided full access to the Lease Area <br /> during the fease improvemen# process. Lessee shall select a qualified architect <br /> and general contractor to complefie improvement of the Premises in accordance <br /> with plans and specifications approved by Lessee and Lessor ("Plans and <br /> Specifications") using only licensed contraciors and in accardance with Buitding <br /> Codes and other government laws and regulations, including, without limitation, <br /> the Americans with Disabi4ities Act ("ADA"}. <br /> 10.3 Lessee shal( submit copies of i#s' contractors' and subcontractors' insurance <br /> documents evidencing the coverage provided and naming the l.essee as <br /> additional insured for their contractors'or subcantractors'work. <br /> AtlylAgr/2008.033 g <br /> 050508 <br />
