6.1 G <br /> Page 10 <br /> AT7ACHMENT 2 <br /> 10.4 Lessee shatl pay, when due, all claims for labor or materials furnished or alieged <br /> to have been fumishecf to or for Lessee, at or for use in the Premises, which <br /> claims are or may be secured by any mechanics' ar material men's liens against <br /> the Premises ar any interest therein. Lessee shaN give Lessor not fewer#han ten <br /> (1q) days' nofice priar to the commencemen# of any work in the Premises, and <br /> Lessor shatl have the right ta post notices of non-respansibility in or �n the <br /> Premises as provided by law. tf Lessee shafl, in good faith, cantest the validity of <br /> any such lien, claim or demand, then Lessee shall, at its sale expense defend <br /> itself and Lessor against the same and shafl pay and satisfy any such adverse <br /> judgment that may be rendered thereon, before the enforcement #hereaf against <br /> the Lessor or #he Premises. However, if Lessor shall require, Lessee shall <br /> fumish to Lessor a surety bond satisfac#ory to Lessor in an amount equa!to such <br /> contested lien claim ar demand, indemnifying �essor against liability and holding <br /> the Premises free from the effect of such (ien or cfaim. In addition, Lessar may <br /> require Lessee ta pay Lessor's attorneys' #ees and costs in participating in such <br /> action if Lessor shall decide it is in its best interest to do so. Lessee shali pravide <br /> such payment, letter of credit or pertormance and payment bonds as requested <br /> by Lessor. Lessee shall maintain performance and payment bonds in an amount <br /> not less than 125% of the anticipated costs of the Lessee Improvements, or such <br /> other amount as Lessor shall from time to time require. <br /> 10.5 Natice of Completion. Lessee shaA complete construction of the lmprovemen#s <br /> within ninety �9p) days after fi�e Lease Commencement Date and Lessee shaH <br /> immediately upon eompletion af constructian give written notiee ta Lessor of such <br /> completi�n. <br /> 11. ALTERATIONS AN�ADDITIONS <br /> 11.1 After completion of Initial Improvements, Lessee shall not, without Lessor's priar <br /> written consent, make any al#erations, improvements, additions, or utility <br /> installations in, on or about the Premises. {n any event, Lessee shall make nq <br /> change or alteration to the interior and/or exterior of the Premises without <br /> Lessor's prior written consent. Lesso�may require that Lessee remove any or all <br /> of said alterations, improvements, addi#ions ar Utility (nstal(atians and require <br /> Lessee to provide Lessar, at l.essee's sole cost and expense, with a payment <br /> and performance bond in an amount equal to one and one-half #imes the <br /> estimated cast of removal of such improvements, to insure Lessor against any <br /> liability for mechanics' and material men's liens and to insure completion of the <br /> wark. Shouid Lessee make any aiterations, improvements, additions or Utility <br /> Instalfations without the prior approval of Lessor, Lessor may require that Lessee <br /> remove same. <br /> 11.2 Requests for any alterations, improvements, additions or Utility lnstallations in, <br /> on, or about ihe Premises that Lessee shalf desire to make and which require the <br /> consent of the Lessor shall be presented to �essor in written form, wi#h proposed <br /> detaifed plans. If Lessor shall give its consent, the consen# shatl be deemed <br /> conditioned upon Lessee acquiring necessery permits from appropriafe <br /> governmen#af agencies, the furnishing ofi a copy thereof to Lessor prior to the <br /> commencement o#the wark, and tt�e comp)iance by Lessee with al! conditians of <br /> said permits. <br /> 11.3 Should Lessor consenf to aiterations of the Premises, Lessee shall submit to <br /> Atty/Agr/2008.033 � <br /> 050508 <br />
