Ail <br /> approved pfans and specifications shail be in compliance with al1 taws, ruies, <br /> permi#s and authorizations from a(I pertinent governmerttal authorities and quasi- <br /> governmental authorities, including, but not limited to, thase required under the <br /> ADA. <br /> 11.4 Uniess Lessor requires their removai, as set for�h in paragraph 11.1, all <br /> aiterations, improvements, additions and Utility Installations (whether or not such <br /> Utility Installations constitute trade fixtures of Lessee}, made on the Premises, <br /> shal! become the praperty of Lessor and remain upon and be surrendered with <br /> the Premises at the expiration af the term. Notwithstanding the provisions of this <br /> paragraph, Lessee's machinery and equiprt�ent, other fhan that which is affixed to <br /> the Premises so that it cannat be removed without material damage to the <br /> Premises, shall remain the property af Lessee and may be removed by Lessee. <br /> 11.5 After the Lessee improvements are complete, Lessee shal! prepare an tnventory <br /> of Fixtures of all new equipment. The Inventory of Fixtures wili incfude the seriai <br /> number, brand name, and model number of each piece of equipment. In <br /> addition, Lessee shall develop a schedule of inspection and cieaning acceptable <br /> to Lessor for each piece af equipment. Upon compietion of the tnventary of <br /> Fixtures and approval by the Lessor, the Inventory of Fixtures will be attached io <br /> this Lease as Exhibit D. <br /> 11.6 Lessee is prohibited from painting any and all windows of the Premises without <br /> the p�ior writ#en consent o# Landlord. Lessee further agrees to maintain the <br /> winrlows properly and in good repair, free of l�aks, defects, cracks, shattering, or <br /> any other defect at Lessee's sale c�st and obligation. Lessee will immediately <br /> notify Lessor af any window damages and will immediately cause the windows#o <br /> be repaired. Lessee will clean the windows using an appropriate cleaning <br /> medium that wil! not etch, scratch, or ciaud or fog the windaws. <br /> 11.7 Lessar reserves #he right at any time to make alterations or additions to tMe <br /> Premises. This lease confers no rights either with regard to the subsurface of the <br /> Eand below the ground level of the Premises Qr with regard to airspace above the <br /> roof of the premises. <br /> 12. ENTRY <br /> 12.1 Lessor's Riah# of En#ry. Lessor, its agents, contractors, employees and assigns <br /> may enter the PremPses wi#h a minimum of twenty-faur(24) hours advance notice <br /> of such entry when practicable to: (a} examine the Premises; (b} perform any <br /> obligate of, or exercise any right or remedy of, Lessor under this Agreement; {c) <br /> make repairs, alterations, improvements ar additic�ns fo the Premises, or ta the <br /> Building as Lessor deems necessary; (d) perform work necessary to comply with <br /> laws, ardinances, rules or reguiations of any pubtic authority or of any insurance <br /> underwri#er; (e) to post "for ren#" or ufor lease" signs or to show prospective <br /> Tenants the Premises; and (f� perfarm work that Lessor deems necessary fio <br /> prevent waste ar deterinration in connection wi#h the Premises should Lessee fail <br /> to commence to make, and diligently pursue to completion, its required repairs <br /> wi#hin three (3) days after wriften demand therefore by Lessor. <br /> Atty/Agr/2008.033 g <br /> 050508 <br />
