The Licensee does not hoid any estate or interest in the property ofi the <br /> City in the public right of way by virtue of this licensa. The City may formuiate <br /> rules, conditions of license, regulations and a permit process for #he use of the <br /> public property and right of way area surrounding and in close proximi#y to #he <br /> Premises, and the uses of other ar+eas in the public righ# way of the City. The <br /> areas surrounding the Premises may be governed thereby and the Lessee <br /> agrees to be bound by these rules and regulations and obtain such permits or <br /> licenses as may be required. These areas may be govemed by this lease to the <br /> exten# it is not in canflict rnrith City rules, regufations, and permit requirements as <br /> they now or hereafter exist. <br /> Lessor shall af alt times retain exclusive finai authority over the public right af way <br /> including the Lic�nse Area. Lessor shall have the right to pertorm any and ali <br /> acts af construction and maintenance in the public right af way, includfng the <br /> License Area, as fulfy and compfete�y as if the iicense for the use of the License <br /> Area did not exist. Lessor wfll not be liable to the �essee by reason of any injury <br /> to or interference with Lessee's business or property for any incanvenience or <br /> damages caused thereby. <br /> The lease term applicable ta the Premises does nof appEy to the License Area <br /> and Lessor retains the right at its sole discretion to terminate or revoke said <br /> license at any time. Termination ar revocation of the Licensee's use of the <br /> License Area is not a grounds for termination ofi the lease. Termination or <br /> resfri�tion of the use of the License Area does not reduce rental payments due <br /> under the Lease Agraement. <br /> 39. AMENDMENT <br /> 39.1 The terms of this Agreement may be amended only in wrifing and by mutua( <br /> agreement between the Agency and the lessee. <br /> 40.
