Would the initiative apply to a newly~acquired parcel of land that would be <br />used for a new park? <br /> <br />No, nothing in the initiative limits the City's ability to acquire new land not covered by <br />the initiative and designate that land for a park. Such action would not require voter <br />approval. <br /> <br />In addition, even if the City Council designates the newly-acquired land as one of <br />the General Plan or Zoning Code designations covered by the initiative (such as "Park" or <br />"Tidal Plain"), that designation would not then require voter approval for any changes to the <br />use of that land in the future. Put otherwise, any land that is redesignated in the future to <br />one of the designations listed in the initiative would still not be covered by the initiative <br />because the initiative applies only to lands with those designations as of March 13, 2008, <br />when the initiative was drafted. For example, a parcel of land that currently is zoned <br />"Commercial/Industrial" but is subsequently converted to a park and rezoned "Tidal Plain" <br />(a designation covered by the initiative) would not be covered by the initiative because it <br />was not zoned "Tidal Plain" as of March 13, 2008. <br /> <br />2. Would two-thirds voter approval be required for a land-swap where, for <br />example, the City would permit Jardin de Ninos Park to be used for charitable <br />purpose and then build a new park in a new location? <br /> <br />No, two-thirds voter approval would not be required because Jardin de Ninos Park is <br />not covered by the initiative. Thus, a land-swap of this park with another parcel could be <br />accomplished without being subject to the initiative. <br /> <br />3. Would two~thirds voter approval be required for the City to acquire a currently <br />vacant parcel, build a park on it, and sell a nearby park site, which is covered <br />by the initiative, to another party to build housing units on it? <br /> <br />Yes; if the proposed land-swap included a covered park, then housing could not be <br />built on that site without two-thirds voter approval. That is because the construction of <br />housing is not one of the permissible uses of lands covered by the initiative. <br /> <br />As discussed above, however, the acquisition of new land for the purpose of <br />building a new park would not require two-thirds voter approval. <br /> <br />4. Would two-thirds voter approval be required for the City to acquire land <br />currently zoned "Industrial" or "Residential" for the purpose of building a teen <br />center or new park? <br /> <br />No; the initiative applies only to "Tidal Plain" and "Redwood Shores Bay Fronr <br />zoning districts and therefore any change to "Industrial" or "Residential" districts are not <br />covered by the initiative and would not require two-thirds voter approval. <br /> <br />5 <br />
