Would two-thirds voter approval be required for a land-swap where the City <br />relocated Veterans Memorial Senior Center in a covered park but then built a <br />new park at the current location of the Center? <br /> <br />As discussed above, two-thirds voter approval likely would be required for a land- <br />swap where the City relocated the Veterans Memorial Senior Center to a covered park <br />but then built a new park at the current location of the Center. As discussed above, the <br />Senior Center conducts many activities consistent with cultural not park or recreational <br />facilities. Thus, in order for the Center to be built for current activities in a covered park, <br />two-thirds voter approval would likely be required. <br /> <br />Nothing in the initiative, however, would prohibit the City from restoring the current <br />site of the Veterans Memorial Senior Center to park use. <br /> <br />4. Would two-thirds voter approval be required to place a fire station in a <br />covered park and then relocate the park to a new parcel? <br /> <br />Yes, two-thirds voter approval would be required. A fire station is not consistent with <br />the uses permissible at covered parks. It would not come within the "public park and public <br />recreation areas or facilities" exception and therefore relocating a fire station to a covered <br />park would have to be approved by a two-thirds vote of the people. <br /> <br />Section II <br /> <br />1. The Preserve at Redwood Shore. Would any change to the current plans for <br />The Preserve at Redwood Shores (also known as Area H) require two-thirds <br />voter approval? <br /> <br />The initiative could affect the project if the scope of the project changes in the future. <br /> <br />The Preserve at Redwood Shores is a mixed-use development that will consist of <br />approximately 93 acres of restored tidal wetlands, a new elementary school, a community <br />park, and 144 to 158 town homes. City Council recently approved the project by amending <br />the General Plan and Zoning Map for the area and approving a Precise Plan for the <br />project. The developer has recently submitted an application for a planned community <br />permit. The Planning Department has not yet approved the application. <br /> <br />The project area currently has General Plan designations of "Open Space <br />(Unimproved Area)" for the wetlands area, "Park" for the community park, Residential <br />Medium Density" for the residential area, and "Schools" for the site of the elementary <br />school. The area is zoned "Precise Plan" on the Zoning Map. Thus, only the "Open <br />Space" area and "Park" would be covered by the initiative. As a result, any change of uses <br />within the residential or school sites would not require voter approval. However, if the <br />scope of the project changed so that the boundaries of the "Open Space" or "Park" were <br />affected, then two-thirds voter approval would be required. For example, if it was <br />determined that the school site should be adjusted to include some portion of adjacent <br />Open Space area, then two-thirds voter approval of such modification would be required. <br /> <br />4 <br />
