<br />heavy equipment. Any damage to Courthouse Square including the pavilions caused by <br />the installation or removal of Lessor's property shall be repaired at the sole cost and <br />expense of the Lessee. <br /> <br />10. All Lessee improvements or equipment moved to the assigned premise must be <br />scheduled with the Lessor at least two days before the Lessee improvements or <br />equipment move. Before the Lessee improvements, Lessee must provide the Lessor a <br />copy of an acceptable contractor insurance. Lessee will be liable for all damages to <br />Courthouse Square that may arise from the Lessee improvements or equipment move. <br /> <br />11. The delivery area for Courthouse Square is the loading zone located along Hamilton and <br />Middlefield between Broadway and Marshall, between the hours of 6 AM and 12 PM, <br />everyday. No vehicles or trucks are allowed on Courthouse Square without written <br />permission from the City. <br /> <br />12. All materials used in connection with the alteration or refurbishment of the Premises, <br />including, without limitation, paint, carpet wall or window coverings, carpet glues and other <br />chemicals, shall be subject to the City's prior written approval. <br /> <br />13. Lessee should notify the City, when it plans to have Pest Control performed in the <br />Premises. Lessee should request a copy of all Materials Safety Data Forms for all <br />materials used from Contractor performing the work. <br /> <br />14. Lessee will not bring, generate, treat, store, or dispose of any chemicals, materials or their <br />potential pollution sources without the City's prior consent <br /> <br />15. Lessee will comply with the City's Ordinances and other government regulations. <br /> <br />16. Restroom facilities provided to Lessee are for the use of the Lessee employees, <br />customers, and the general public. <br /> <br />17. Each Lessee shall cooperate with the Lessor in keeping the Premises neat and clean. <br />Nothing shall be swept or thrown onto Courthouse Square, fountains, stairways, corridors, <br />or elevator shafts except the designated trash and recycling containers provided by both <br />the City and Lessee. <br /> <br />18. In order to coordinate all garbage service and cleaning of Premise, Lessee should notify <br />the Lessor of name, times and scope of work of contracted janitorial services. The Lessor <br />will provide the appropriate access and provide guidelines to the use of garbage areas <br />and the Lessor's recycling programs. <br /> <br />19. Employees of the Lessor shall not perform any work or do anything outside of their <br />regular duties affecting the assigned Premises unless under special instructions from the <br />Lessor and no employees shall admit any person, Lessee or otherwise, to any Lessee <br />space without speCific instruction from the Lessor. <br /> <br />20. Lessor reserves the right by written notice to Lessee to reasonably rescind, alter or waive <br />any Rule or Regulation, or to enact additional Rules and Regulations at any time when in <br />the Lessor's judgment, for the safety, protection, care and cleanliness of the concession <br />spaces, the operation thereof, the preservation of good order therein, and the protection <br />and comfort of its Lessees, their agents, employees and invitees. <br /> <br />ATTY/AGR12007.067 <br />
