<br />Lease Area. Lessor, with 24-hours notice to the Lessee, shall enter Lessee's <br />premises monthly to read the water and sewer meter. The electricity charge will <br />be based on actual usage by the Lessee. The telephone /Intemet, cable hookup <br />shall be arranged directly with the communications company. <br /> <br />7.4 Interruotlon. Lessor shall not be liable for any failure or interruption of any utility <br />service being furnished to the Lease Area, and no such failure or interruption <br />shall entitle Lessee to terminate this Lease. <br /> <br />7.5 Trash and Recvclina. Lessee is solely responsible for removing its waste and <br />recycling generated as a result of its business operations. The waste and <br />recycling area shall be designated by the Lessor. <br /> <br />8. RETAIL SERVICE <br />8.1 Use of Lease Area. Lessee Is an independent contractor under the business <br />name Lulu's. for the operation of selling batteries, film, disposable cameras, <br />seasonal merchandise, aspirin, lozenges, gifts, novelties periodicals, fresh <br />flowers and plants, candy, and gum only and for no other purpose without written <br />approval by the Lessor. <br /> <br />(a) Any significant product change shall be approved by Lessor. Lessor shall <br />not unreasonably withhold approval of requested changes except when <br />the proposed product change will infringe, unfairly compete with, or <br />duplicate the offerings and/or sales of another Courthouse Square <br />Pavilion Lessee. <br /> <br />8.2 Lessee's Duties. Lessee shall hire an adequate number of persons in order to <br />sell products in a prompt and timely manner under this Lease. <br /> <br />8.3 Payment of Lessee's EmDlovees. Lessee shall pay all persons hired as required <br />by law, Including but not limited to, income tax withholding and social security <br />payments. No employee of Lessee shall be deemed to be an employee of <br />Lessor. <br /> <br />8.4 Quality of Products. All products and presentation shall be first class with the <br />minimum standard being high quality food and service comparable to or <br />exceeding those of other similar businesses. The highest standard of cleanliness <br />and sanitation on the premises shall be maintained without exception. <br /> <br />8.5 Manaaement of the Concession Soace. Lessee shall manage the concession <br />space as stated in Section 1.1 and all operations therein. <br /> <br />8.6 Hours of ODeration.
