<br />Lessor all plans and specifications which shall be subject to the Lessor's prior <br />written approval, which shall not be unreasonably withheld or delayed. All <br />approved plans and specifications shall be in compliance with all laws, rules, <br />permits and authorizations from all pertinent governmental authorities and quasi- <br />governmental authorities, including, but not limited to, those required under the <br />ADA. <br /> <br />11.4 Unless Lessor requires their removal, as set forth in paragraph 11.1, all <br />alterations, improvements, additions and Utility Installations (whether or not such <br />Utility Installations constitute trade fixtures of Lessee), made on the Premises, <br />shall become the property of Lessor and remain upon and be surrendered with <br />the Premises at the expiration of the term. Notwithstanding the provisions of this <br />paragraph, Lessee's machinery and equipment, other than that which is affixed to <br />the Premises so that it cannot be removed without material damage to the <br />Premises, shall remain the property of Lessee and may be removed by Lessee. <br /> <br />11.5 After the Lessee improvements are complete, Lessee shall prepare an Inventory <br />of Fixtures of all new equipment. The Inventory of Fixtures will include the serial <br />number, brand name, and model numberrof each piece of equipment. In <br />addition, Lessee shall develop a schedule of inspection and cleaning acceptable <br />to Lessor for each piece of equipment. Upon completion of the Inventory of <br />Fixtures and approval by the Lessor, the Inventory of Fixtures will be attached to <br />this Lease as Exhibit D. <br /> <br />11.6 Lessee is prohibited from painting any and all windows of the Premises without <br />the prior written consent of Landlord. Lessee further agrees to maintain the <br />windows properly and in good repair, free of leaks, defects, cracks, shattering, or <br />any other defect at Lessee's sole cost and obligation. Lessee will immediately <br />notify Lessor of any window damages and will immediately cause the windows to <br />be repaired. Lessee will dean the windows using an appropriate cleaning <br />medium that will not etch, scratch, or cloud or fog the windows. <br /> <br />11.7 Lessor reserves the right at any time to make alterations or additions to the <br />Premises. This lease confers no rights either with regard to the subsurface of the <br />land below the ground level of the Premises or with regard to airspace above the <br />roof of the premises. <br /> <br />12. ENTRY <br />12.1 Lessor's Rieht of Entrv. Lessor, its agents, contractors, employees and assigns <br />may enter the Premises with a minimum of twenty-four (24) hours advance notice <br />of such entry when practicable to: (a) examine the Premises; (b) perform any <br />obligate of, or exercise any right or remedy of, Lessor under this Agreement; (c) <br />make repairs, alterations, improvements or additions to the Premises, or to the <br />Building as Lessor deems necessary; (d) perform work necessary to comply with <br />laws, ordinances, rules or regulations of any public authority or of any insurance <br />underwriter; (e) to post "for renr or "for lease" signs or to show prospective <br />Tenants the Premises; and (f) perform work that Lessor deems necessary to <br />prevent waste or deterioration in connection with the Premises should Lessee fail <br />to commence to make, and diligently pursue to completion, its required repairs <br />within three (3) days after written demand therefore by Lessor. <br /> <br />Atty/Agrl2008.033 <br />050508 <br /> <br />8 <br />
