<br />5.1E <br />Staff maximizes preservation of trees by encouraging property owners to allow the City Page 2 <br />to establish a sidewalk maintenance easement in front yards (on private property) for <br />the relocation of portions of the sidewalk adjacent to trees. If an easement is not <br />provided, temporary repairs will be made prior to the installation of poured-in-place <br />rubber surfacing which will be done at a later time under separate contract, in order to <br />avoid tree removal. Council was made aware of the use of rubber sidewalk material in <br />the 2005/2006 cost shared sidewalk repair projects. The poured in place rubber <br />sidewalk process is superior to the use of pre-fabricated rubber panels. The sites <br />where poured in place rubber sidewalk was installed several years ago have proved to <br />be a very good substitute for concrete. <br /> <br />Property owners are offered the 50/50 cost shared option to correct offsets less than <br />one inch. If property owner wants to replace undamaged and contiguous concrete they <br />must pay 100% ofthat repair. <br /> <br />ALTERNATIVES <br />1. Award the contract to a higher bidder. Staff is confident the low bidder can <br />complete the project. <br />2. Re-bid the contract. Staff does not believe a better price will be received through <br />another bid. <br /> <br />FISCAL IMPACT <br />Funds totaling $1,398,448 are available in the FY2007-2008 Capital Improvement <br />Program Tree Preservation and Sidewalk Repair Program. Additional funds in the <br />amount of $950,000 are expected to be allocated for this project in the FY 2008-2009 <br />Capital Improvement Program budget cycle. These amounts support staff costs <br />associated with managing the projects as well as the cost of the two projects funded by <br />this program: the Cost Shared Sidewalk Repair Project and the 100% Tree Preservation <br />and Sidewalk Repair Program.
