<br />County Elections Office released the results, staff determined that is was infeasible to <br />analyze the results, write a staff report. issue a certification and amend the agenda and <br />agenda packet in time for the June 23. 2008 meeting. The County released the <br />information on the afternoon of June 19, 2008, after the agenda and meeting materials <br />had been finalized and released. <br /> <br />7A <br />Page 2 <br /> <br />Staff feels a responsibility to mention two additional items regarding the petition format, <br />neither of which, however, affect the sufficiency of the petition. First, certain words were <br />not capitalized in the notice of intention and title and summary of the petition sections <br />circulated. This does not change the validity of the petition format but staff noticed this <br />slight discrepancy. Second, one resident called the City Clerk's Office after the petition <br />had been submitted and requested that his name be withdrawn. According to Elections <br />Code ~ 9264, residents can withdraw their signatures from the petition if they contact <br />the elections official prior to the filing of the petition. Because that was not the case, the <br />signature was submitted to the County for verification. The City Clerk received no other <br />requests from voters to withdraw their signature. <br /> <br />II. Election Resolutions <br /> <br />City Council must next call an election for the initiative, decide on an election date for <br />the initiative and, depending on when that is, pass a resolution calling a special election <br />and consolidating the election with other elections. Staff requests direction from City <br />Council on each of these issues and will bring those resolutions back to the Council for <br />approval. <br /> <br />A. Timina of Election <br /> <br />Election Code ~ 9255 governs when a Charter Amendment must be submitted for a <br />vote: <br /> <br />. . . charter proposals shall be submitted to the voters at <br />either a special election called for that purpose, at any <br />established municipal date, or at any established election <br />date pursuant to Section 1000, provided that there are at <br />least 88 days before the election . . . <br /> <br />The City's next regularly scheduled municipal election is November 3, 2009. The City <br />could also call a special election for the initiative. If City Council decides to place the <br />matter on the November 4, 2008, election ballot, it would have to do so no later than <br />August 8, 2008 (88 days from the election date). and it would have to call a special <br />election and request consolidation with the statewide presidential general election. <br /> <br />Staff will be prepared to answer any questions about how this provision applies to the <br />initiative. <br /> <br />B. Necessary Election Resolutions <br /> <br />If Council decides to place the initiative on the November ballot, it would have to pass a <br />resolution or resolutions, no later than August 8, 2008, doing all of the following: <br /> <br />1. Calling a special election for the initiative for November 4, 2008; <br />
