<br />that caused the City Council to draft an alternative measure to the one submitted by <br />petition. In light of these legal concerns, the City Attorney advises City Council not to <br />proceed with a second alternative measure at this time but to consider the revised <br />version of the City Council measure. The revised version (with and without mark-ups) <br />is attached hereto as Attachment "A-1 and A-2". <br /> <br />7A <br />Page 2 <br /> <br />The City Council may direct that further changes be made or may accept the revised <br />version of the measure to be submitted to the voters of Redwood City and order it <br />placed on a ballot. In the event the City Council orders a City Council measure be <br />placed on the ballot, a draft resolution has been prepared and is attached hereto as <br />Attachment "B". All exhibits to the resolution will be attached if adopted. <br /> <br />At the July 28,2008 meeting, the City Council also considered calling for a special <br />municipal election and requesting its consolidation with the statewide election to occur <br />on November 4, 2008. The City Council deferred action of this matter to August 4, <br />2008. In the event the City Council calls and gives notice of a special municipal election <br />for November 4, 2008 and requests that the special municipal election be consolidated <br />with the statewide election, resolutions have been drafted and are attached hereto as <br />Attachments "C-1 and C-2". All exhibits to the resolutions will be attached if adopted. <br /> <br />At the July 28,2008 meeting, the City Council also requested that alternative ballot <br />questions be drafted and presented. Below are the ballot questions presented in the <br />July 21, 2008 staff report and alternative ballot questions, both of which the City <br />Attorney believes are fair and impartial. <br /> <br />1. The Voter Approval Requirement Regarding Future Development of Cargill <br />Lands (the "Majority Vote Amendment") <br /> <br />"Shall a Charter Amendment requiring majority voter approval for future land uses <br />other than agriculture, public parks, certain extractions from San Francisco Bay, or <br />restored wetlands on Cargill Lands, consisting of 1,450 acres east of Highway 101 <br />and south of Seaport Boulevard, be adopted?" <br /> <br />"Shall a Charter Amendment requiring majority voter approval for future <br />development of the Cargill Lands, consisting of 1,450 acres east of Highway 101 <br />and south of Seaport Boulevard, with exceptions for takings and vested rights, be <br />adopted?" <br /> <br />2. A City Charter Amendment Requiring Two-Thirds Vote of the City Voters to <br />Change the General Plan Designation or Zoning Ordinance Uses for Certain <br />Lands in the City (the "Two-Thirds Vote Amendment") <br /> <br />"Shall a Charter Amendment requiring two-thirds voter ratification of legislative <br />acts approving future land uses other than agriculture, public parks, extractions <br />from San Francisco Bay, or restored wetlands in areas of City designated as <br />"Park", "Unimproved Areas (Land or Water), "Future Development Expanding <br />Limits of Urbanization", "Controlled Waterways (Redwood Shores Area)", or "San <br />Francisco Bay Water" in the General Plan or designated as "Tidal Plain" or <br />"Redwood Shores Bay Front" in the Zoning Code, be adopted?" <br /> <br />2 <br />
