<br />6.1A <br />Page 11 <br /> <br />Access shall be restricted so as not to interfere with the normal operations of <br />the department or with established safety or security requirements. <br />Solicitation of membership and activities concerned with the internal <br />management of the Association, such as collecting dues, holding membership <br />meetings, campaigning for office, conducting elections and distributing <br />literature shall not be conducted during working hours unless approved in <br />advance by the City Manager or his or her designated representative. <br /> <br />SECTION 4. CITY RIGHTS <br /> <br />To insure that the City is able to carry out its constitutional, chartered and statutory <br />functions and responsibilities, nothing contained herein shall be construed to require <br />the City to meet and confer on matters which are solely a function of management, <br />including the right to direct the work force; to select and determine the number and <br />types of employees required; to determine the content of job classifications; to hire, <br />transfer, promote, suspend, discipline and discharge employees; to assign work to <br />employees in accordance with the requirements of the City; to establish and change <br />work schedules and assignments; to layoff employees for lack of work; to expand or <br />diminish services; to subcontract any work or operations; to determine and change <br />methods of operations; to determine and change work locations and the processes <br />and materials to be employed; to take all necessary actions to perform its functions in <br />emergencies. <br /> <br />SECTION 5. ASSOCIATION REPRESENTATIVES <br /> <br />City employees who are official representatives or unit representatives of the <br />Association shall be given reasonable time off with pay to attend meetings with <br />management representatives, labor conferences, labor training seminars, or to be <br />present at hearings where matters within the scope of representation or grievances <br />are being considered. The use of official time for this purpose shall be reasonable and <br />shall not interfere with the performance of City services as determined by the City <br />Personnel Officer. Such Employee representatives shall submit a written request for <br />excused absence to the Police Department Head or his or her designated <br />representative with an information copy to the City Manager, at least two (2) weeks <br />prior to the scheduled meeting, labor conference, or labor training seminar whenever <br />possible. Except by mutual agreement, the number of employees excused for such <br />purposes shall not exceed two (2) contingent upon minimum staffing requirements. <br />The affected shift supervisor will post any necessary overtime to backfill their <br />respective shift; however, if there are no takers for the overtime, no officer will be <br />compelled to work overtime and permission will not be granted for the requested <br />absence. It is incumbent on the association representative who is attending the <br />meeting, labor conference of labor training seminar to check with the affected shift <br />supervisor to ensure that in the event any overtime is needed, it is posted and filled. <br /> <br />5 <br />
