<br />REPORT <br /> <br />6.38 <br />Page 1 <br /> <br />To the Honorable Mayor and City Council <br />From the OitY; Manager <br /> <br />September 8, 2008 <br /> <br />SUBJECT <br />Fifth Amendment to the Sanitary Sewerage Treatment Capacity Rights and Services <br />(Town of Woodside) Agreement <br /> <br />RECOMMENDATION <br />Approve, by resolution, the Fifth Amendment to the Sanitary Sewerage Treatment <br />Capacity Rights and Services (Town of Woodside) Agreement. <br /> <br />BACKGROUND <br />On May 7, 1997 the Town of Woodside entered into an agreement with the City of <br />Redwood City and the Fair Oaks Sewer Maintenance District for sewer treatment and <br />conveyance. The Town of Woodside agreed to: <br />1. Acquire 100,000 gallons per day of Stage 2 sewer treatment capacity to service their <br />Town Center from the City of Redwood City, a member agency of the South Bayside <br />System Authority ("SBSA"), and <br />2. Compensate the Fair Oaks Sewer Maintenance District and the City of Redwood <br />City for the use of their sewer facilities to transport the Town of Woodside's <br />sewerage to SBSA's treatment plant for treatment and disposal. <br /> <br />The agreement limits the service area to the Downtown Area of the Town of Woodside <br />(Town Center, Agreement Exhibit A-1), and the area from Palm Circle Road to Godetia <br />Drive, and from Canada Road to Glencrag Way (Expansion Area, Agreement Exhibit A- <br />2). Any changes to the service area require approval by the City of Redwood City and <br />the Fair Oaks Sewer Maintenance District. <br /> <br />Four amendments to the Sanitary Sewerage Treatment Capacity Rights and Services <br />(Town of Woodside) Agreement have been approved to date. All four amendments <br />have been for the purpose of annexing properties into the Town Center service area <br />due to failed on-site sewage disposal systems. The four effected properties (shown in <br />Agreement Exhibit B) are contiguous to the Town Center service area and/or have the <br />capability of being sewered by gravity into the Town Center's sewer facility. <br /> <br />The proposed fifth amendment, requested by the Town of Woodside, amends the <br />agreement to include nine parcels in the Town of Woodside that are contiguous to the <br />Fair Oaks Sewer Maintenance District. Please see Attachment 2. These parcels have, <br />or may have at some future date, a failure of on-site sewage disposal systems and <br />require connection to the nearest publicly operated and maintained sewer system to <br />protect the public health. The closest point of connection is currently provided by the <br />Fair Oaks Sewer Maintenance District. <br /> <br />Terms and conditions of the proposed fifth amendment vary from those of previous <br />amendments. The nine parcels proposed for inclusion in the fifth amendment <br />. will not be part of the 100,000 gallons per day treatment capacity acquired by the <br />Town of Woodside, and <br />
