<br />6.1C <br />Page 6 <br /> <br />ATTACHMENT 1 <br /> <br />In the event of bankruptcy or other debtor-creditor proceedings against Licensee, <br />such Security Deposit shall be deemed to be applied first to the payment of The <br />license fee, Additional License fee and other sums due Licensor for all periods <br />prior to the filing of such proceedings. <br /> <br />5. PREMISES AREA MAINTENANCE COSTS, REPAIR AND UTILITIES <br />5.1 Maintenance. licensee shall at all times during the license term, at Licensee's <br />sole expense maintain the License Area in clean and safe condition for the use <br />contemplated in this Agreement <br /> <br />5.2 Fire ExtinQuisher. licensee, at his/her own expense will provide, maintain and <br />repair fire extinguisher(s) for licensee's Premises. <br /> <br />5.3 Utility CharQes. Licensee agrees to pay for all connections and charges and/or <br />assessments for water, sewer, and electricity associated with the operation of the <br />license Area. licensor, with 24~hours notice to the Licensee, shall enter <br />Licensee's premises monthly to read the water and sewer meter. The electricity <br />charge will be based on actual usage by the licensee. The telephone /Internet, <br />cable hookup shall be arranged directly with the communications company. <br /> <br />5.4 Interruotion. licensor shall not be liable for any failure or interruption of any <br />utility service being furnished to the license Area. and no such failure or <br />interruption shall entitle Licensee to terminate this License. <br /> <br />6. CAFE SERVICES <br />6.1 Exclusive Food Provider. Licensee is an independent contractor with the <br />exclusive right and privilege to operate the Cafe within Redwood Shores Library and to <br />sell and dispense food as may be permitted by the City of Redwood City. <br /> <br />6.2 Use of Cafe Soace. Licensee shall use the Cafe space for food preparation, food <br />consumption, and/or sale. <br /> <br />6.3 Licensee's Duties. Licensee shall hire an adequate number of persons in order to <br />provide food services in a prompt and timely manner under this License. <br /> <br />6.4 Payment of Licensee's Emolovees. Licensee shall pay all persons hired as <br />required by law including but not limited to income tax withholding and social security <br />payments. No employee of Licensee shall be deemed to be an employee of City of <br />Redwood City. <br /> <br />6.5 Price of Food. All food sold shall be sold at reasonable prices as determined by <br />Licensee. <br /> <br />6.6 Quality of Food. All food and presentation shall be first class with the minimum <br />standard being high quality food and service comparable to or exceeding those of other <br />retail, non-subsidized cafes. The highest standard of cleanliness and sanitation on the <br />premises and in the course of food preparation shall be maintained without exception. <br /> <br />6.7 Cross Contamination. Every effort shall be made to avoid cross contamination of <br />foods and food borne illness. Employees with any communicable disease shall not work <br />in areas where contamination can occur.
