<br />18.1.2 Business Automobile Liability Insurance. Business automobile <br />liability insurance policy which provides coverage at least as broad as ISO <br />form CA 00 01 with policy limits a minimum limit of not less than one <br />million dollars ($1,000,000) each accident using, or providing coverage at <br />least as broad as, Insurance Services Office form CA 00 01. Liability <br />coverage shall apply to all owned, non-owned and hired autos. In addition <br />to the Performance Fee as set forth in Section 4 of the Agreement entitled <br />"Live Performance Agreement," the Agency shall pay, as additional <br />compensation, the cost of procuring the Business Automobile Liability <br />coverage described above and purchased in order to cover these <br />Performances, and such cost shall not exceed one thousand dollars <br />($1,000). <br /> <br />18.1.3 Workers' Compensation and Employer's Liabilitv. Workers' <br />Compensation limits as required by the California Labor Code and <br />Employer's Liability limits of $1,000,000 per accident for bodily injury. <br />Workers' Compensation and Employer's Liability insurance will not be <br />required if Performer has no employees and provides, to Agency's <br />satisfaction, a declaration stating this <br /> <br />18.2. Additional Provisions. Performer will ensure that the policies of insurance <br />required under this Agreement contain, or are endorsed to contain, the following <br />provIsions: <br /> <br />18.2.1 For Commercial General Liability Insurance, Agency and City, their <br />officers, agents, volunteers and employees will be named as additional <br />insureds. <br /> <br />18.2.2 This insurance will be in force during the life of the Agreement and <br />any extensions of it and will not be canceled without thirty (30) days prior <br />written notice to Agency sent pursuant to the Notice provisions of this <br />Agreement. <br /> <br />18.3 Providinq Certificates of Insurance and Endorsements. Prior to first <br />payment, Performer will furnish certificates of insurance and endorsements to <br />Agency for Commercial General Liability. Prior to second payment, Performer <br />will furnish certificates of insurance and endorsement to Agency for Business <br />Automobile Liability Insurance.. <br /> <br />18.4 Failure to Maintain Coveraqe. If Performer fails to maintain any of these <br />insurance coverages, then Agency will have the option to declare Performer in <br />breach, or may purchase replacement insurance or pay the premiums that are <br />due on existing policies in order to maintain the required coverages.
