ORIGINAL <br /> AMENDMENT NO. 2 <br /> TO AGREEMENT FOR <br /> ENVIRONMENTAL CONSULTING SERVICES <br /> (Wagstaff and Associates a division of MIG) <br /> This Amendment No. 2 is entered into and effective as of the 1 41 day of <br /> , 2011, amending the agreement dated September 19, 2008 (the <br /> "Agre ent by and between the City of Redwood City, a charter city and municipal <br /> corpo tion ( "City "), and Wagstaff and Associates a division of MIG, ( "Consultant ") <br /> (collectively, the `Parties ") for environmental consulting services related to Stanford in <br /> Redwood City Precise Plan EIR. <br /> RECITALS <br /> A. On September 19, 2008, the Parties executed Agreement for Environmental <br /> Consulting Services; and <br /> B. On March 16, 2010, the Parties executed Amendment No. 1 to Agreement for <br /> Environmental Consulting Services; and <br /> C. The Parties have negotiated and agreed to a supplemental scope of work <br /> and fee schedule, which is attached to and incorporated by this reference as Exhibit <br /> "A," Scope of Services and Fee. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. In addition to those services contained in the Agreement, as may have <br /> been amended from time to time, Consultant will provide those services described in <br /> Exhibit "A." <br /> 2. City will pay Consultant for the services described in "Exhibit A" attached <br /> hereot in an amount not to exceed Sixty Five Thousand Four Hundred Twenty Nine <br /> Dollars and Ninety Cents ($65,429.90). The aggregate amount of the Agreement <br /> including Amendment 1 and Amendment 2 is ($504,964.90) and Consultant shall be <br /> paid in an amount not to exceed the aggregate amount for all services under the <br /> Agreement and Amendments 1 and 2. Consultant will provide City, on a monthly basis, <br /> copies of invoices sufficiently detailed to include hours performed, hourly rates, and <br /> related activities and costs for approval by City. <br /> 3. Consultant will complete all work described in Exhibit "A" by the <br /> completion of performances of services hereunder by consultant. <br /> 4.
