8A <br /> Page 5 <br /> CITY OF REDWOOD CITY <br /> ENERGY SERVICES CONTRACT <br /> This Agreement is made this day of_, 2008 between the CITY OF REDWOOD CITY, a <br /> charter city and municipal corparatian in the State of California ("Owner" or "City"), and RC <br /> CONSTRUCTWN I Robert Rago ("Contractor"}. The work described in Section 1 below shall be <br /> pertormed in accardance with the Exhibit"A,"attached hereto and incorporated herein by this reference. <br /> In 2007, the City joined the Association of Bay Area Governments {ABAG) Energy Watch <br /> Partnership. The joint partnership with PG&E and Energy Solutions pertormed an energy evaluation of <br /> nineteen City owned facilities which resulted in the proposa! from their construction component, ABI <br /> Services, lnc. an energy services company. Governmen# Code Sections 42t7.91 through 4217.17 <br /> pravides that notwithstanding any other provisions of faw, a public agency may enter into an energy <br /> service contract on terms that its gaverning body determines a�e in the best interests of the public <br /> agency. A detaiied "Lighting Work Order"was develaped for each facitity listing all work to be instafled. <br /> Exhibit"A"tists the relevant Lighting Wark Orders for each of the 16 Ci#y�+vned facilities. <br /> The fotlowing documenfs are incorporated into and made part of this Con#ract by this reference: <br /> • Lighting Work Orders lisfed in Exhibit"A"for each of fhe 96 City Owned facilities <br /> which are on file and made available in the City Clerk's Office <br /> • Clocument Ofl670 Construction Performance 8ond <br /> • Document 00620 Construction Labor and Material Paymenf Bond <br /> The documents shall be referred to collectiveiy as the"Contract Documen#s". <br /> SECTION 1 —SCOPE OF WORK <br /> Cantractor shali fumish ali necessary management,supervision, iabor,materiafs,tools,supplies, <br /> equipment,plan#,services,engineering,testing and/or any other ac#or thing required to dilige�#!y <br /> and fufly perform and complete the work described in the Exhibit"A". <br /> Cantractor shall compiy with atl requirements of the Contract Documents. Where there is a conflict <br /> between the requi�ements of the severai Contract Documents, the more stringent requi�ements shall <br /> govern. <br /> Contractor's scope of warlc includes,but is not limited to,the following: <br /> • °Contracta" shall furnish all labor, materials and equipment to perfarm alf work required for the <br /> compfetion of the work in Exhibit "A." Submif all required samples, product data, certificates, <br /> operations and maintenance instruckions, guarantees, and other submittais no iater than five (5) <br /> days after the date the City issues a Notice to Proceed. <br /> • Protect alf mater"sals to be used in the Warfc in accordance with the specifications. <br /> • Frotec# existing facilities and personal property.
