<br />6.3A <br />Page 24 <br /> <br />COMPLIANCE WITH APPLICABLE LAWS AND REGULATIONS <br /> <br />49, PERMITS, LICENSES, APPROVALS AND LEGAL OBLIGATIONS: Project <br />Sponsor shall be responsible for obtaining any and all permits, licenses, and <br />approvals required for performing its obligations under this Implementation <br />Agreement Project Sponsor shall comply with the California Environmental <br />Quality Act (California Public Resources Code Section 21000 et seq.) and other <br />applicable federal, State, and local laws, rules, regulations, guidelines, and <br />requirements prior to disbursement of State Grant funds under this <br />Implementation Agreement. <br /> <br />Project Sponsor agrees to comply with all applicable California Labor Code <br />requirements, including prevailing wage provisions. Project Sponsor must, <br />independently or through a third party, adopt and enforce a Department of <br />Industrial Relations-certified Labor Compliance Program (LCP) meeting the <br />requirements of Labor Code section 1771.5 for projects funded by: <br /> <br />Proposition 50 (Water Security, Clean Drinking Water, Coastal <br />and Beach Protection Act of 2002; Cal. Water Code sections <br />79500 et seq.) <br /> <br />Project Sponsor's failure to comply with the LCP requirements is a substantial <br />breach of this Implementation Agreement. At BACWA's or DWR's request, <br />Project Sponsor must promptly submit written evidence of Project Sponsor's <br />compliance with the LCP requirements. <br /> <br />50. COMPETITIVE BIDDING AND PROCUREMENTS: Project Sponsor shall <br />comply with all applicable laws and regulations regarding securing competitive <br />bids and undertaking competitive negotiations in Project Sponsor's contracts with <br />other entities for acquisition of goods and services and construction of public <br />works with funds provided by BACW A under this Implementation Agreement <br /> <br />51. AMERICANS WITH DISABILITIES ACT: By signing this Implementation <br />Agreement, Project Sponsor assures BACW A that it complies with the Americans <br />With Disabilities Act (the "ADA") of 1990, (42 U.S.C. S 12101 et seq.), which <br />prohibits discrimination on the basis of disability, as well as all applicable <br />regulations and guidelines issued pursuant to the ADA. <br /> <br />52. NONDISCRIMINATION: During the performance of this Implementation <br />Agreement, Project Sponsor and its contractors and subcontractors shall not <br />unlawfully discriminate, harass, or allow harassment against any employee or <br />applicant for employment because of sex, race, color, ancestry, religious creed, <br />national origin, physical disability (including HIV and AIDS), mental disability, <br />medical condition (including cancer), age (over 40), marital status, and denial of <br />family care leave. Project Sponsor and its contractors and subcontractors shall <br />ensure that the evaluation and treatment of their employees and applicants for <br />employment are free from such discrimination and harassment.
