<br />Exhibit A <br /> <br />A. PURPOSE <br /> <br />1. With initial funding from the Skoll Foundation, the David and Lucille Packard Foundation and the <br />Office of the President of Stanford University, and most recently the Thrive Foundation, the John <br />W. Gardner Center (JGC) is collaborating with SPHERE and a host of community partners on the <br />development of the Youth Data Archive (YDA), an archive of matched longitudinal administrative <br />data for conducting policy analyses for San Mateo County leaders and practitioners. <br /> <br />2. Policy questions to be addressed using the YDA will be developed in collaboration with the City of <br />Redwood City and representatives of local educational institutions, governmental agencies, and <br />youth-serving organizations which contribute data to the YDA. <br /> <br />B. NATURE OF DATA <br /> <br />Because the Youth Data Archive will match individual student level data, these data are expected to <br />contain confidential information, the disclosure of which is restricted by a provision of law. Some <br />examples of "confidential information" include, but are not limited to, "personal information" about <br />individuals as defined in California Civil Code Section 1798.3 of the Information Practices Act and <br />"personal information" about students as defined by the Code of Federal Regulations CFR Title 34 <br />Volume 1 Part 99.3. <br /> <br />C. SPHERE AND JGC RESPONSIBILITIES; <br /> <br />SPHERE and JGC agree to the following confidentiality statements: <br /> <br />1. SPHERE and JGC acknowledge that the confidential data is confidential and proprietary to <br />Redwood City, and agree to protect all confidential information from unauthorized disclosures and <br />comply with all applicable confidentiality laws including but not limited to, the Health Insurance <br />Portability and Accountability Act (HIPAA), the California Education Code and the Family <br />Education Rights and Privacy Act (FERPA). JGC and SPHERE are responsible for complying <br />with and enforcing all District, Local, State and Federal confidentiality applicable laws and <br />regulations. <br /> <br />2. SPHERE and JGC shall designate Marqaret O'Brien-Strain, Senior Research Associate, The <br />SPHERE Institute, as the person responsible for the security and confidentiality of the data and <br />will notify Redwood City immediately in writing of any change in designee. <br /> <br />3. SPHERE shall instruct all staff with access to confidential information about the requirements for <br />handling confidential information and the sanctions for unauthorized disclosure or use of <br />confidential and private information. No confidential data will be improperly released by <br />Consultants. <br /> <br />4. SPHERE shall provide all staff with access to confidential information statements of organizational <br />policies and procedures for the protection of human subjects and data confidentiality. <br /> <br />5. SPHERE will use any information which could potentially allow the identification of any individual <br />only for the purpose of creating the data sets and analyzing the data. Information which could <br />potentially identify any individuals will be maintained in a separate data set and used only to create <br />and update the linked data archive. <br /> <br />City Attorney Approved Version #05.22.01 <br /> <br />4 <br />
