<br />6.38 <br />Page 1 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />November 10,2008 <br /> <br />SUBJECT <br />Amendment of San Mateo Countyl Cities Joint Nondisposal Facility Element <br /> <br />RECOMMENDATION <br />Adopt a resolution amending the Joint Nondisposal Facility Element (NOFE) to include Ferma <br />Corporation's proposed medium volume (25-174 tons/day) Construction and Demolition/Inert <br />(CDI) and medium volume (200-500 ton/day) Wood Debris Recycling Facilities on a three acre <br />site located at 475 Seaport Boulevard on Port of Redwood City property (Attachments 1 and 2). <br /> <br />BACKGROUND <br />In April of 2004, Redwood City (as well as San Mateo County and most cities within the County) <br />adopted a Joint NDFE.1 (See Attachment 3 for a summary of Nondisposal Facilities in San <br />Mateo County; the complete NDFE document is provided at the City Clerk's Office). The <br />California Public Resources Code requires every city and county in the State to prepare and <br />adopt a NDFE that identifies all existing, expansion of existing, and proposed new nondisposal <br />facilities which will be used by a city or county to assist in reaching the State solid waste landfill <br />diversion mandates. A nondisposal facility is defined as any solid waste facility required to <br />obtain a State solid waste facility permit, except disposal facilities and transformation facilities. <br />Nondisposal facilities include material recovery facilities, compost facilities and transfer stations. <br />While solid waste facility permits are not required for small volume facilities, they are required for <br />medium volume facilities. San Mateo County Environmental Health Department, the local <br />enforcement agency for jurisdictions in San Mateo County, processes solid waste facility permits. <br /> <br />On May 14, 2008, the Port of Redwood City approved a temporary rental agreement with Ferma <br />Corporation that allows Ferma to operate a small volume (24 tons/day) COI Debris Processing <br />Facility and small volume (199 tons/day) Wood Debris Chipping & Grinding Facility at 475 <br />Seaport Boulevard.2 The Port has land use approval authority over 475 Seaport Boulevard and <br />other Port properties. <br /> <br />On September 19, 2008, as required by the Public Resources Code, Ferma Corporation also <br />made an application with the City to amend the Joint NDFE to include a proposed medium <br /> <br />1 The California Integrated Waste Management Act of 1989 directed cities, counties and regional agencies to <br />prepare a Countywide or Reglonwide Integrated Waste Management Plan. In accordance with State law, the San <br />Mateo County ICities Plan consists of a Source Reduction and Recycling Element (SRRE), Household Hazardous <br />Waste Element (HHWE) and a Non-Disposal Facility Element (NO FE) for each jurisdiction within San Mateo <br />County, and a Countywide Integrated Waste Management Plan Summary and Siting Element <br /> <br />2 The Port's rental agreement with Ferma is on file with the Port and can be terminated at any time upon a 30 <br />day notice by either party. <br /> <br />1 <br />
