<br />. <br /> <br />4 <br /> <br />.. <br />. .. <br /> <br />~ ,4"' "- <br /> <br />~ ---, <br /> <br />SECTION 2: <br /> <br />The terms, oonditions, restriotions and limitations <br /> <br />under whioh this franohise, and the rights, privileges, permits <br />and immunities thereby oonferred and granted are as follows, to- <br />wit: <br /> <br />FIRST: <br /> <br />The railroad traoks to be laid under this franohise <br /> <br />shall be laid along the oenter of the streets and highways traversed <br />thereby, or as near thereto as existing oonditions will allow. <br /> <br />SECOND: <br /> <br />Said railway shall be of standard oonstruotion and <br /> <br />be built of first olass material . <br /> <br />THIRD: <br /> <br />The grantee of this franohise, its sucoessors or assigns, <br /> <br />shall,at its or their expense, pave or macadamize the said railway <br />between the rails thereof, and for two (2) feet on eaoh side thereof, <br />with the same material as is now used or that may hereafter be used <br />from time to time for suoh purposes by said Town, and under the same <br />speoifioations and in the same manner as upon the streets or portions <br />of streets over whioh said railway runs, or the traok or traoks there- <br />of are laid, and shall keep the same oonstantly so paved and macadam~ <br />ized, flush with the street. <br />All the foregoing work to be done to the satisfaotion <br />of the Board of Trustees of the Town of Redwood City. <br /> <br />FOURTH: <br /> <br />The road bed of said railway shall oonform at all times <br /> <br />to the established grade of the street or streets on or over whioh <br />the same is laid, provided however, that where any of suoh streets <br />have been graded or otherwise improved prior to the granting of <br />this franohise, said road bed'and rails of said railway shall oonform <br />to and be flush with the surface of said graded or otherwise improved <br />
