SECTION The terms, conditions, restrictions and limitations <br /> under which this franchise, and the rights, privileges, permits <br /> and immunities thereby conferred and granted are as follows, to- <br /> wit: <br /> FIRST: The railroad tracks to be laid under this franchise <br /> shall be laid along the center of the streets and highways traversed <br /> thereby, or as near thereto as existing conditions will allow . <br /> SECOND: Said railway shall be of standard construction and <br /> be built of first class material <br /> THIRD: The grantee of this franchise, its successors or assigns, <br /> shall. at its or their expense, pave or macadamize the said railway <br /> between the rails thereof, and for two (2) feet on each side thereof, <br /> with the same material as is now used or that may hereafter be used <br /> from time to time for such purposes by said Town, and under the same <br /> s eoi isattons and in the same manner as upon the streets or portions <br /> of streets over which said railway runs, or the track or tracks there- <br /> of are laid, and shall keep the same constantly so paved and macadam- <br /> ized, flush with the street <br /> All the <br /> foregoing work to be done to the satisfaction <br /> of the Board of Trustees of the Town of edwood City <br /> The road bed of said railway shall conform at all times <br /> to the established grade of the street or streets on or over which <br /> the same is laid, provided however, that where any of such streets <br /> have been graded or otherwise improved prior to the granting of <br /> this frandhise, said road bed and rails of said railway shall conform <br /> to and be flush with the surface o said graded or otherwise mproved <br /> street or streets whether such surface be above or below the official <br /> grade thereof, and on all other streets said road fed shall conform <br /> to the official grade thereof. <br />
