<br />20) CONCESSIONS- Lessor shall dispense during said event and for Lessee's guests all beverages, through <br />Lessor's bar facility. Said beverages shall consist of bottled water, fountain sodas, beer and wine, and well <br />drinks. Lessee shall not pay for all beverages consumed (no-host bar). Lessee shall have the right to serve <br />food at this event at its own expense for all labor and material. Lessee shall take full responsibility to clean up <br />all food concessions facilities. <br /> <br />21) MARQUEE - Lessee shall have the right to 1-sided marquee mention of its event for no less than 24 hours <br />prior to each event. Marquee will be maintained and mention installed by Lessor at its costs. Lessee under- <br />stands and agrees that it may share the limited marquee space with other events to be held during the 24-hour <br />period of Lessee's mention and that its marquee mention may have to be an abbreviated version. <br /> <br />22) BROADCASTING - No performance or event presented in the Fox Theatre shall be broadcast or televised, <br />or in any manner recorded for reproduction, without the written consent of Lessor, and then only upon the ex- <br />press condition that all expenses pertaining thereto will be paid in advance by Lessee. Such expenses shall <br />include, but not be limited to, all seats removed from public sale by camera positions, union reproduction fees. <br />Lessee shall make every effort to give the Fox Theatre recognition in credits of said event, performance, video <br />or filmed production. Notwithstanding the foregoing, Lessee shall be permitted to produce video recordings for <br />archival and publicity purposes and for provisions of copies to performers and staff. Lessor may not record in <br />any manner any part or parts of the production, performers, staff without prior written approval of Lessee's <br />Authorized Representative. <br /> <br />23) PHOTOGRAPHY - No photos shall be taken of Lessee's production, choreography, artistic or staff person- <br />nel by any person at any time without the prior written permission of Lessee's Authorized Representative. <br />Content of photos or likenesses remain the exclusive intellectual property of Lessee and shall not be printed, <br />distributed or reproduced in any manner including, without limitation, electronic media, without the prior written <br />consent of Lessee's Authorized Representative. <br /> <br />24) STORAGE - In the receipt, handling, care or custody of property of any kind shipped or otherwise delivered <br />to the Little Fox, either prior to, during or subsequent to the use of the Little Fox, by Lessee, Broadway Enter- <br />tainment, LLC and its officers, agents and employees shall act solely for the accommodation of Lessee; and <br />neither Broadway Entertainment, LLC nor its officers, agents, or employees shall be liable for any loss, dam- <br />age, or injury to such property. <br /> <br />25) OBSTRUCTIONS - No portions of the sidewalks, entries, passage vestibules, or way of access to public <br />utilities of the premises shall be obstructed, or caused to be obstructed, by Lessee or caused or permitted to <br />be used for any purpose other that ingress and egress to and from the premises. <br /> <br />26) FLAMMABLE MATERIALS - No flammable materials such as bunting, tissue paper, etc., will be permitted <br />to be used for decorations; and all materials used for decorative purposes must be treated with flameproofing <br />and approved by Lessor. <br /> <br />27) EXHIBIT ENTRANCE - All articles, exhibits, fixtures, materials, displays, etc., shall be brought into or out of <br />the Little Fox only at such entrances as may be designated by Lessor. <br /> <br />28) CONTROL OF THE LITTLE FOX - The Premises, including keys thereto, shall be at all times under the <br />control of Lessor and other authorized representatives of Lessor shall have the right to enter the Premises at <br />all times (juring the period covered by this agreement. The entrances and exits of said Premises shall be <br />locked and unlocked at such times as may be required for Lessee's use of the Premises. <br /> <br />29) CIVIL RIGHTS - Lessee agrees not to discriminate against any employee or any applicant for employment <br />because of race, color, religion, ancestry, sex, age, physical handicap not related to job performance or na- <br />tional origin.
