<br />30) NON-RESPONSIBILITY - Lessor shall not be responsible for any damages or inability to provide the Les- <br />see with the use of the Premises as agreed, if such inability is due to acts of God, fire, earthquake, strikes, la- <br />bor disputes or other causes beyond the control of Lessor. Lessor shall not be responsible for damages <br />caused directly or indirectly by Lessee's exhibitors, guests, attendees, invitees, or contractors. Neither shall the <br />Lessor be responsible for property brought upon the premises by Lessee, their exhibitors, guests, attendees, <br />invitees, or contractors. Lessee shall, at his/her own expense, place any required and/or necessary security <br />guards to assure the security of Lessee's own property. Notwithstanding the foregoing, Lessor shall assure <br />that doors to the Premises are secure and locked during non-use hours. <br /> <br />31) OCCUPANCY DISRUPTION - In case the Premises or any part thereof shall be destroyed by acts of God, <br />fire, earthquake or any other cause, or if any casualty or unforeseen occurrence including but not limited to <br />strikes, labor disputes, wars or acts of military authorities, shall render the fulfillment of the agreement difficult <br />or impossible to perform, this agreement shall be, at once, canceled and all sums paid to Lessor shall be im- <br />mediately refunded to Lessee. Lessor shall not, in any case, be held liable or responsible to Lessee for any <br />damage caused by said cancellation, and Lessor shall be relieved from any further liability by reason of this <br />Lease, and no claims for compensation or damage shall be made against Lessor by Lessee. <br /> <br />32) OBJECTIONABLE PERSONS - Lessor reserves the right to eject from the premises any objectional per- <br />son or persons; and neither Broadway Entertainment, LLC nor any of its officers, agents or employees shall be <br />liable to Lessee for any damages that may be sustained by Lessee through the exercise by Broadway Enter- <br />tainment, LLC of such rights. <br /> <br />33) SCHEDULING - Unless otherwise specified in writing, Lessor shall be privileged to schedule other similar <br />events before and after dates of this contract without notice to Lessee. <br /> <br />34) FREE SAMPLES - Neither Lessee, nor Lessee's exhibitors, shall give away or sell items under the terms <br />of this permit without the written permission from the Lessor. <br /> <br />35) LOST ARTICLES - Lessor or its representatives shall have the sole right to collect and have the custody of <br />articles left in the building by persons attending any event, performance, exhibition or entertainment given or <br />held in the demised premises, and the Lessee or any person in Lessee's employ shall neither collect nor in- <br />terfere with the collection or custody of such articles. <br /> <br />36) BREACH OF CONTRACT - Breach of any of the above noted conditions vests in Lessor all rights provided <br />bylaw. <br /> <br />37) SUIT - In the event suit is brought to enforce or interpret any part of this agreement, the prevailing party <br />shall be entitled to recover as an element of his costs of suit, and not as damages, a reasonable attorneys fee <br />to be fixed by the Court. <br /> <br />38) PERFORMER CONTRACT AND APPROVAL - Lessee represents and warrants that Lessee will have on <br />the event date contracts with Lessee's performers whose services form the basis for this Lease. <br /> <br />39) COUNTERPARTS - This Lease may be executed in separate counterparts all of which shall constitute a <br />single instrument. <br /> <br />40) NOTICES - All notices, demands and requests shall be in writing and shall be given in person (including by <br />overnight delivery service that obtains a signature upon delivery) or by United States Mail addressed as set <br />forth below with return receipt requested. Notices to Lessee at its address specified in the Basic Lease Infor- <br />mation. Notices to Lessor shall be given to Lessor at P.O. Box 2369, Redwood City, CA 94064.
