Code § 27383. <br />IMPROVEMENT AGREEMENT <br />Stanford in Redwood City Phase 1 <br />k <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this day of <br />E_ , 2017 {"Effective Date") by and between the Board of Trustees of the <br />Leland Sta4ford Junior University, a body having corporate powers under the laws of the State of <br />California ("Developer"), and the City of Redwood City, a charter city and California municipal <br />corporation ("City") with Developer and City hereinafter referred to individually as "Party" and <br />collectively as "Parties." Reference is made to the following facts: <br />RECITALS <br />A . DeveIoper is the current fee owner of that certain real property located within the City of <br />Redwood City, County of San Mateo, State of California, described in Exhibit A, attached hereto and <br />incorporated herein by reference (the "Property"). <br />13. On December 12, 2016, the City Council of the City of Redwood City adopted, among <br />other approvals, Resolution No. 15551, approving the Tentative Map TM2016-002, which is part of the <br />Stanford in Redwood City Phase 1 Project ("Project"), prepared by BKF Engineers and dated July S, <br />2016 ("Tentative Map"), subject to certain conditions of approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br />improvement agreement with City to guarantee the installation of all public improvements required of the <br />Project and to provide for payment of all City inspection and plan check charges associated with the <br />installation of public and private improvements, including but not limited to streets, sanitary sewers, <br />water, storm drains and street lights. <br />D . Developer has submitted the Final Map and applied to City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into the <br />improvement agreement with City providing for the future construction and installation of public <br />improvements, as required by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled "Stanford in <br />Redwood City G2 On-site Improvement Plans", prepared by BKF Engineers and dated February 24, 2017 <br />(the "On -Site Improvement Plans"), which, in addition to other improvements, provide for certain on-site <br />improvements consisting of private street and street light improvements, storm drain systems, sanitary <br />sewer systems, public domestic water systems and services, and public recycled water systems and <br />services, for the Project (collectively, "On -Site Improvements"). <br />Page 1 of 29 <br />ATTY/AGR.2017.073/Stanford - Subdivision Improvement Agreement <br />309 <br />
