6.G. - Page 2 of 7 <br />Streets and Highway Code Section 8333 authorizes the vacation of public service easements by a <br />resolution of City Council. Summary vacation is permitted under Section 8333 as the easement has not <br />been used for the purpose for which it was dedicated or acquired for five consecutive years immediately <br />preceding the proposed vacation, the easement has been determined to be excess by the City, and there <br />are no other public facilities located within the easement. <br />Once completed, the summary vacation will relinquish the City's interest in the easement and the <br />easement area will revert to the fee owners, who are James H. Kang and Ellice Kang. The easement <br />proposed for vacation is more particularly described in a legal description and plat map attached to this <br />report as exhibits to the proposed resolution. <br />FISCAL IMPACT <br />This action will not impose any new financial responsibility onto the City. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to adopt a resolution to vacate the City's interest in an easement. <br />However, this would be contrary to the intent of the parties. <br />ATTACHMENTS <br />Attachment A — Resolution to summarily vacate easement, with Exhibits to Resolution <br />Attachment B — Project Location Map <br />Page 2 of 3 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.ore <br />364 <br />
