Street, from where the BIAC lot ends, including the elbow shaped left turn <br />on that last stretch down to the shelter. <br />The land swap of established or dedicated right of way (the vacation) for a <br />strip of Maple allowing Strada more parking can, of course, only extend to <br />two things: (1) land that is in city title; and (/or) (2) the portion of the <br />right of way that was properly dedicated and established under General <br />Law (vs. Charter, and which applies with respect to roadways even for <br />charter cities), and properly executed boundaries for any such authorized <br />right of way condemnations. <br />Again, I am not necessarily (at all) opposed to the concept of land swap <br />for a portion of the properly dedicated right of way, nor to Blomquist going <br />where it is, but I want to lodge the above objections. First, it is not <br />necessary to have done so in a public hearing, esp. due to insufficient <br />notice, but second, because the city can't do anything with the land that it <br />does not have rights to. So that is outside the bounds of objection in a <br />public hearing to something the City otherwise has the clear right to do. <br />I am putting this on the record. The tech issues were unfortunate, and I <br />hope this can all be worked out without anyone having to establish that <br />Docktown always had the upland parking established by a very consistent <br />easement by use and custom for decades. <br />Thanks, <br />Alison <br />
