expiration of thirty (30) days after Lessor shall have received written notification of cancellation or reduction in coverage by first class mail; (ii) Providing that Contractor's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability (cross-liability endorsements); (iii) Naming Lessor, its Council, cOll1ll1issions, boards, committees, officers, employees and agents as additional insureds; and (iv) Providing that Lessee's insurance shall be primary insurance relating to Lessee's negligence hereunder with respect to Lessor, its Council, commissions, boards, cOlllmittees, officers, employees and agents, and further providing that any insurance or self-insurance maintained by Lessor for itself, its Council, commissions, boards, committees, officers, employees and agents shall be in excess of Lessee's insurance and shall not be contributory with it. 7. DAMAGE, DESTRUCTION AND TERMINATION. 7.01 Right to Terminate. The Lease may be tenninated on thirty (30) days prior written notice as follows: (i) by either party upon a default of the covenant or term hereof by the other party, which default is not cured within thirty (30) days of mailing of written notice of default, provided that the grace period for any monetary default is ten (10) days from mailing of notice; or (ii) by Lessee if it cannot obtain or maintain through no fault of its own any license, permit or other approval necessary for the construction and operation of the Lessee's Facilities; or (iii) by Lessee if Lessee is unable to occupy and utilize the Leased Premises due to an action of the Federal Communications Commission~ including without limitation, a take back of channels or change in ATIY/AGRlZ008,(l<!4 Lease Agreement T.Mobile 121908 17
