<br />frequencies; or (iv) by Lessee if Lessee determines that the Leased Premises are not <br /> <br />appropriate for its operations for economic or technological reasons~ including, without <br /> <br />limitation, signal interference. <br /> <br />7.02. Upon Termination. Upon termination, Lessee shall remove all of Lessee's <br /> <br />communications equipment from the Leased Premises and shall restore the Leased <br /> <br />Premises to its original condition, except for normal wear and tear and casualty beyond <br /> <br />the control of Lessee, and Lessee shall be obligated to pay any accruing Rent prior to the <br /> <br />date of termination of this Lease with any remaining balance to be reimbursed to Lessee <br /> <br />upon Lessee's compliance with the removal and restoration obligations as set forth herein <br /> <br />related to the Leased Premises. <br /> <br />7.03 Damage. Destruction or Condemnation. If the Leased Premises or <br /> <br />Lessee's Facilities are damaged, destroyed or condemned, Lessee may elect to terminate <br /> <br />this Lease by giving written notice to Lessor no more than forty-five (45) days following <br /> <br />the date of such damage, destruction, or condemnation. The Lease shall terminate as of <br /> <br />the date of such damage or destruction and Lessee shall be entitled to reimbursement of <br /> <br />any pre-paid rent that remains unused as of the date of termination. If Lessee chooses not <br /> <br />to terminate this Lease, Rent shall be reduced or abated in proportion to the actual <br /> <br />reduction or abatement of use of the Leased Premises. <br /> <br />8. TAXES. Any and all real property tax, or any other form of tax assessed <br /> <br />or imposed against the Leased Property arising out of, or attributed to, Lessee's <br /> <br />occupancy and use of the Leased Premises, shall be borne exclusively by Lessee. Lessor <br /> <br />shall, during the term hereof, make payment of all real property taxes in general and <br /> <br />special assessments levied against the Site and the Leased Premises, which it has the duty <br /> <br />ATTY/AGR/2008.Q44 Lease Agreement T-Mobile <br />121908 <br /> <br />18 <br />
