<br />to pay. Lessor shall make such payments in order to avoid penalty. Lessee shall <br /> <br />compensate Lessor for any real property taxes directly attributable to the value of <br /> <br />Lessee's improvements on the Leased Premises, which payment shall be made by Lessee <br /> <br />to Lessor within twenty (20) days after the date Lessee receives written notice from <br /> <br />Lessor of the amount due. Lessor's notice to Lessee shall provide docUlnentation <br /> <br />reasonably satisfactory to Lessee of the amount of Lessee's portion of such real property <br /> <br />taxes. Lessee has the right to challenge, whether in a Court, Adlninistrative Proceeding, <br /> <br />or other venue, on behalf of Lessor and/or Lessee, any personal property or real property <br /> <br />tax assessments that may affect Lessee. If Lessor receives notice of any personal <br /> <br />property or real property tax assessment against the Lessor, which may affect Lessee and <br /> <br />is directly attributable to Lessee's installation, Lessor shall provide timely notice of the <br /> <br />assessment to Lessee sufficient to allow Lessee to consent to or challenge such <br /> <br />assessment. Further, Lessor shall provide to Lessee any and all documentation associated <br /> <br />with the assessment at no cost to the Lessor. <br /> <br />9. UTILITIES. <br /> <br />9.01 Payment. Lessee shall pay for all water, gas, heat, light, power, telephone <br /> <br />and other utilities and services, if any, supplied to the Leased Premises, together with any <br /> <br />taxes thereon at the rate charged by the servicing utility provider. <br /> <br />9.02 Access to Electricity and Other Utilities. Lessee shall be solely <br /> <br />responsible for bringing electricity and/or other utilities to the Lea~ed Premises. Lessor <br /> <br />does not warrant the present and/or future availability of utilities to the Site. Lessee also <br /> <br />has the right to bring only underground utilities across the Site in order to service the <br /> <br />Leased Premises.
