of each such lien on the assessment books for city taxes against the <br /> respective parcels charged and thereafter the amount of each such lien <br /> shall be collected in the same manner, at the same time, and be subject <br /> to the same additional penalties as are established for the payment of <br /> general city taxes . <br /> SECTION 11. Proof of the posting or mailing of any notice, order <br /> or determination provided for in this ordinance may be made by the affi- <br /> davit of the person posting or mailing the notice, order or determination <br /> annexed to a copy of such order, notice or determination posted or mailed, <br /> as the case may be, and specifying the date when or at which the same was <br /> posted or mailed as the case may be. It shall be the duty of the engin- <br /> eer to keep among the official records of his office the affidavits of <br /> posting or mailing herein provided for, and no error in the name or <br /> address and no failure to receive a copy of the notices mailed as herein <br /> provided shall affect in any manner the validity of the procedure or of <br /> any lien imposed hereunder. <br /> SECTION 12. No charge, or any act relating to such charge, or the <br /> collection of the same hereunder, shall be illegal on account of infor- <br /> mality, or because the same was not completed within the time required <br /> by law. <br /> SECTION 13. This ordinance shall be known and designated as the <br /> "Sidewalk and Driveway Ordinance". <br /> ARTICLE II <br /> SECTION 1. No work of breaking out and/or construction of side- <br /> walks and driveways within any public right of way shall be undertaken <br /> by any person without a permit first being obtained from the engineer' s <br /> office. A required permit fee of W1.00 shall accompany each application <br /> for a permit. <br /> SECTION 2. No permit shall be issued by the engineer unless and <br /> until any contractor proposing to do such work shall fine a performance <br /> bond with and payable to the city, in an amount not less than 4500.00. <br /> SECTION 3. Any sidewalk or driveway shall be broken out and con- <br /> struced to standard city specifications, drawings of which are on file <br /> and available in the engineer ' s office. In case of defective work not <br /> corrected to the satisfaction of the engineer, no further permits shall <br /> be issued to applicant, and performance bond given hereunder shall be <br /> cancelled. <br /> SECTION 4. Applicantions for permits by individual owners of pro- <br /> perty shall be accompained by a cash deposit of 41)25..00 as a guaranty to <br /> construct the work to city specifications and to remove and dispose of <br /> debris left on city right of ways, which cash bond shall be refundable <br /> Anly after work has been accepted by city and all debris properly re- <br /> moved. <br /> SECTION 5. DRIVEWAYS. <br /> (a) Business and Industrial Driveways: No driveway shall be of <br /> greater width than 40% of the actual lot frontage on any one street, <br /> ncr more than 23 feet, whichever is the lesser. In case of more than <br /> one driveway in front of any property, the total width of driveways shall <br /> not exceed the 40% of frontage hereinbefore mentioned, and there shall be <br /> 20 feet or a multiple thereof of standard curb, gutters and sidewalk <br /> between such driveways. <br /> (b) Residential Driveways : Single driveways shall not exceed 12 <br /> feet in width and double driveways shall not exceed 23 feet in width <br /> between the tops of ramps at the ends of driveways. <br /> SECTION 6. REPLACEMENT OF CURB AND SIDEWALK AT ABANDONED DRIVEWAYS. <br /> (a) "Abandoned driveway" is defined as any driveway for which there <br /> appears to be no immediate reasonable use as such, or where the use or <br /> conditions of the abutting property has been so changed that the driveway <br /> is no longer needed. <br /> -3- <br />
