<br />expiration of any grace or cure periods, (except in the case of an emergency, in which <br /> <br />case no notice requirement or cure period shall apply), to perform such obligations on <br /> <br />Lessee's behalf and put the same in good order, condition and repair, and the cost thereof <br /> <br />together with interest thereon at the maximum rate then allowable by law shall become <br /> <br />due and payable within thirty (30) days of Lessee's receipt of an invoice together with <br /> <br />reasonable supporting documentation from Lessor. <br /> <br />5.03 Lessor's Obligations. Lessee shall maintain in good order and repair the <br /> <br />structural portions of the structure(s) in which Lessee's equipment is located. Lessor <br /> <br />shall have no obligation to repair andlor maintain the Leased Premises nor the <br /> <br />improvements thereto and facilities placed thereon by Lessee, except to the extent such <br /> <br />repairs are required due to the active negligence, sole negligence, or willful misconduct <br /> <br />of Lessor or its agents or employees. <br /> <br />5.04 Security Measures. Lessor has no obligation to provide any security <br /> <br />measures at the Site. Lessee may provide reasonable security measures for its facilities <br /> <br />provided that such measures shall not limit Lessor's use of the Site in any way consistent <br /> <br />with the terms and conditions of this agreement. Lessee shall obtain prior approval from <br /> <br />Lessor before installing or implementing any security system, device, operation or plan to <br /> <br />protect the Leased Premises and/or the Site. <br /> <br />5.05 l1nprovements. <br /> <br />(a) Lessee has the right to erect, maintain, and operate on the Leased <br />Premises radio communications facilities, including an antenna tower or poIe(s) and <br />foundation, utility lines, transmission lines, an air-conditioned equipment shelter, <br />electronic equipment, radio transmitting and receiving antennas and supporting structures <br />thereto ("Lessee's Facilities"). In connection therewith, Lessee has the right to do all <br />work reasonably necessary to prepare, maintain and alter the Leased Premises for <br /> <br />ATTY/AGRl2008,044 Lease Agreement T.Mobile <br />121908 <br /> <br />10 <br />
