Lease, Lessee shall maintain such permits, licenses and approvals in force throughout the term of this Lease. Lessee shall be solely responsible for conducting any environmental review required to be undertaken in association with Lessee's use of the Leased Premises and for any and all costs associated therewith, as well as any and all fees, charges, or other expenses that may be imposed by the City or other regulatory agencies prior to the Commencement Date or at any time during the term of the Lease. Lessee shall provide Lessor with copies of all Lessee's licenses issued by the FCC in connection with or relating to the Site. (b) Lessor agrees to cooperate with Lessee in obtaining the local permits and other required governmental approval, and, without limiting the generality of the foregoing, to execute any applications, maps, certificates, or other documents that may be required in connection with local permits. 4.04 Compliance with Laws. Lessee shall not do or permit anything to be done in, on, or about the Leased Premises, or bring or keep anything in, on, or about the Leased Premises, which will in any way violate any law, statute, ordinance or governmental rule or regulation now in force or which may hereafter be enacted or promulgated by any public authority with jurisdiction over the Site or Lessee's operations thereon. 4.05 Condition. Use and Zoning: of Premises. Lessor makes no warranty or representation of any kind concerning the condition of the Leased Premises, or the fitness of the Leased Premises for the use intended by Lessee, or of the applicable zoning regulations to Lessee's proposed use thereof, and hereby disclaims any personal knowledge with respect thereto, it being expressly understood by the parties that Lessee ATIY/AGRJ2008,044 Lease Agreement T-Mobile 121908 6
