7A
ATTACHME~'Qe 7

memo to file

Date: 5/26/2009
To: File
Cc:
From: Sailesh Mehra
RE: Kentfield Project-Planning Commission April 21, 2009 Action
Documentation

The attached DRAFT Notice of Official Action (NOA) was not finalized and
issued because there was an appeal filed on April 27, 2009. Staff halted
drafting the NOA in order to prepare the Council staff report, to respond to
the appellants' data requests, and to conduct other related research. As
suCh, no NOA will be issued until after the City Council renders a decision.

This draft NOA incorporates the findings made by the Planning Commission
for three actions: Adoption of a Mitigated Negative Declaration; approval of
a Planned Development Permit; and approval of a Tentative Map. The
conditions of approval include the Planning Commission's specific direction
with respect to additions and modification to the conditions. They also
include standard conditions. The Mitigated Negative Declaration was
modified by the Planning Commission, which determined that amendments
to some of the mitigation measures were needed.

When the NOA is issued, there will be no new appeal period because an
appeal has already been filed. Doing so will not eliminate due process.

Sailesh Mehra

Attachment: DRAFT Notice of Official Action

5/26/2009

1
