The privately owned <br />area between the decorative fence and <br />sidewalk shall be landscaped and maintained <br />by the homwowner. <br /> <br />"Section 36.4. Special Provisions <br /> <br />"a. Sight Clearance for Streets and Driveways. In <br /> <br />order to insure visibility and safety, no solid fence or <br /> <br />hedge exceeding 3 feet in height shall be located within a <br /> <br />15 foot triangle on either side of a driveway providing <br /> <br />access to required on-site parking or where two streets <br /> <br />intersect on the corner (refer to Sections 36.8 and 36.9). <br /> <br />"b. Exceptions to Height Restrictions. <br /> <br />"(1) Whenever the provisions of this article <br />establish a maximum height limit of 7 feet <br />for a fence, such height may be increased to <br />10 feet in any district except the PO, AG, or <br />any R District upon approval of an <br />Architectural Permit. <br /> <br />"(2) Lamp posts or pilasters may exceed the height <br />allowed under the ordinance upon review and <br />approval by the Zoning Administrator, but <br />shall not exceed 7 feet in any case. <br /> <br />"c. Siting Limitation. No privately constructed fence <br /> <br />shall be located on the public right-of-way. <br /> <br />"Section 36.5. <br /> <br />Construction and Landscape Standards. <br /> <br />All fences shall meet the following standards. <br /> <br />"a. Fences open to public view shall be constructed <br /> <br />and maintained so as not to sag or lean. <br /> <br />"b. The fence shall not be a safety hazard to <br /> <br />motorists and/or pedestrians. <br /> <br />5 <br />
