To the best of our ability, RBG will provide the Corps with the information necessary to make a jurisdictional determination in accordance with the Rapanos guidance and within the estimated cost. Phase 2. Corps Permit Authorization Process Task 1. Prepare Corps Permit Application. HBG will prepare and subn1it a pre discharge notification for a Nationwide Permit (s) to the Corps for placement of any fill in waters of the United States, including wetlands. The notification will include the standard permit application form, project description, technical documentation of the wetland delineation, an evaluation of how the project complies with the conditions of the Nationwide Permit Authorization. Upon client approval, HBG will provide the permit and required documentation to the Corps for review and approval. This proposal assumes that 110 hours of time plus expenses are necessary for this Task. This proposal also assumes that the client will contract for and provided detailed engineer level design documents and plans, as needed. Task 2. Prepare Endangered Species Consultation Documentation. HBG will prepare docunlents necessary to initiate a consultation with the USFWS and NMFS pursuant to Section 7 of the Endangered Species Act and related to potential impacts to federally-listed species that could result from the project. These documents are to include a draft Corps letter requesting the Section 7 consultation, a Biological Resources Assessment report. This proposal assumes that 110 hours of tinle plus expenses are necessary for this Task. Task 3. Prepare Essential Fish Habitat Consultation Documentation. HBG will prepare documents necessary to initiate an EFH consultation with the NMFS. These documents are to include a draft Corps letter requesting the EFH consultation, an Essential Fish Habitat Assessment report. This proposal assumes that 25 hours of time plus expenses are necessary for this Task. Phase 3. RWaCS Water Quality Certification Process Task 1. Prepare RWQCB Application for State 401 Water Quality Certification. HBG will prepare the authorization request for State 40 1 Water Quality Certification following current RWQCB guidelines for submission. Included with the application submittal will be copies of the environmental assessment, conceptual wetland n1itigation plan and alternatives discussion. HBG will also submit with the application package a Stormwater Pollution Prevention Plan (SWPPP) and Post-construction Stormwater Management Plan (SWMP) in order to expedite the approval process. This proposal assumes that 80 hours of tinle plus expenses are necessary for this Task. HBG assumes the SWPPP and SWMP will be prepared by the Applicant. Phase 4. BCDC Development Permit Authorization Process Task 1. Prepare BCDC Application for a San Francisco Bay Development Permit. HBG will prepare the authorization request following current Bcnc guidelines for submission. Included with the application submittal will be copies of the environmental assessment, conceptual wetland mitigation plan.
