6.1 C <br /> Page 6 <br /> NUW THEREFQRE, the par�ies agree as follows: <br /> 1. GRANT OF �EASE , <br /> 1.1 Lessor hereby grants to Lessee d lEase iar use o�f the premise consisting of ane - <br /> 14'-42" x 13'-29" (191.fi square feet) enclosed area for food preparation and <br /> distribution, subject to the agreements, conditions and provisions set forth in thfs <br /> Agreement and the procuremen# of required permit(s} from the San Mateo <br /> �ounty Hea��h Department. Lessee acknovt►iedges that it will be accepting th� <br /> Premises in i#s completed condition per building plans that were completed by <br /> FMG Architects, Bid Sets, February 10, 2006 �"Bid Sets"). Said Bid Sets have <br /> been reviewed by Lessee, and are incorporafied herein by this reference. Lessee <br /> shall haVe the right to m�asure the size of the Lease Area to insure size <br /> accuracy. The Lease provisions may be adjusted according to sucn <br /> measurements prior to the execution of the Lease. <br /> �.2 Lessee aeknowledges that it recognizes the un�queness af the premises and <br /> accepts them in their current and disclosed condition exis#ing on the date of <br /> execution of this Agreement, subject to all applicabfe zoning, municipal, county, <br /> or state 1aws, ordinances and regulations affecting the use of the Premises. <br /> Lessee acknowiedges that it has satisfied itself, by its own independent <br /> investigation that the Premises are suitable for its intended use and neither <br /> Less�r nor its agents or representatives have rr�ade any �epresentation or <br /> warranty as to the present o�future suifability of the Premises for the conduct of <br /> Lessee's business. <br /> 2. LEASE PERtQD <br /> 2.1 Term. The term of this Agreement shal! be for�en years, commencing upon the <br /> date of the lease execution day (Lease Commencement Date}, and ending on <br /> June 23, 2�19 ("Lease Expiration Date�). <br /> 2.2 Options. Lessee shal( have two options �"Q�tions"} to �x#en� the L�as� Term <br /> for two successive five year periods ("Extended Terms"}. Each Qption shal( be <br /> exercised no earlier than one {1) year, but no [ater than 6� days prior to the last <br /> day of the Lease Term by written no#ice to �essor. Rent far fhe Ex#ended Term <br /> shafl be as described in Secfiian 3. All other terms and conditions of this �ease <br /> shall remain in fufl force and efifect during the Extended Term. <br /> 2.3 nefinition. As used in this Lease the word "Option" has the following rneaning: <br /> (1) the right or option to extend the term of this �ease. <br /> 2.4. �p�ion Exclusive. The 4ption gran#ed to Lessee in this Lease is exclusive to <br /> Lessee and may nafi be exercised or be assigned, voiuntarily or in�olun#arily, by <br /> or to any person or entifiy other than Lessee. <br /> 2.5 Delay in Possession. On #he Lease Commencement Dafe, Lessee shall take <br /> possessian of the Premises.
