6.1C <br /> Page 26 <br /> A. �f Lessee breaches the lease and abandons the Premises before the end <br /> of the terrn, or if his right ta possession is terminated by the Lessor <br /> because of a breach of the lease, the lease terminates. Upon such <br /> t�rritten no�ice o� terrnirtation, the �essor sha!! have the right to reeover <br /> against Lessee: <br /> 1. The worth at the time of award o� fihe unpaid rent that had been <br /> earned at the time of termination; <br /> 2. The worth at the time of award of the amount by which the unpaid <br /> rent that would have been earned affer termination unti! the time <br /> o# award exceeds the amount of thi� ren#a! loss that �essee <br /> proves could have been reasonably a����d�d; <br /> 3. The worth at lhe time of award of the amount by which �he unpaid <br /> rent for the balance of the Terrn after the time of award exceeds <br /> � - the amount of this renfial loss that Lessee proves could be <br /> reasonably avoided; and <br /> 4. Any other amount necessary to compensate Lessor for afE the <br /> detrimen# proximately caused by Lessee's failure to perform <br /> �essee's obfigations under#he Agreement. <br /> B. The worth at the time of av�rard of the amounts referred to in <br /> subparagraphs (1) and (2) of subdivision (A) shall be computed by <br /> al[owing interes# at ten percent (10%) per annum. The wor�h at the time <br /> vf award of the amount referred to in subparagraph {3} of subdivision �A} <br /> shall be computed by discounting this amount at the discoun# rate of the <br /> Federal Reserve Bank of San Francisco at the time of award plus one <br /> percent (1%). <br /> C. Effarts that Lessor may rr�ake to mitigate the damages caused by <br /> �essee's breach of this Agreement shall not constitu#e a waiver of <br /> Lessor's right to recover damages against Lessee, nor shali anything <br /> contained in this Agreement affecfi �essor's right fo indemnification <br /> against Lessee for any liabiiity arising prior to the termination of this <br /> Agreement for personal injuries o�-proper�y damage. <br /> D.
