At that time, Planning staff notified the applicant that school <br />operations could not commence until a Use Permit could be processed. However, on <br />August 29. 2007, WHCA opened the kindergarten through twelfth grade school with a <br />student body of approximately 101 students without benefit of the required permits. <br /> <br />The code enforcement process immediately followed and included site inspections and <br />a work program to ensure that all necessary health and safety concerns were <br />adequately addressed, the most significant of which required WHCA to close the <br />secondary school building because of significant Building and Fire code violations. Staff <br />also worked with both the applicant and a number of concerned neighbors to develop a <br />series of interim measures to provide basic safety measures for teachers and students <br />as well as to minimize adverse impacts to the neighborhoods (Attachment 1). Two <br />special neighborhood meetings, including one that was facilitated by Peninsula Conflict <br />Resolution Center, were conducted to provide a community building opportunity for the <br />neighbors and the applicant. Given that prior tenants were allowed to operate both child <br />care facility and primary school programs on the subject property, the City allowed <br />WHCA, as an interim measure, to maintain up to 65 kindergarten through sixth grade <br />students on-site. The secondary school students, grades seventh through twelfth, were <br />relocated to the Redwood Church property, located at 901/903 Madison Avenue, for the <br />remainder of the 2007-2008 school year via the processing of a separate Temporary <br />Use Permit in an effort to alleviate potential traffic, noise and safety concerns on the <br />subject property until a permanent Use Permit could be acted upon. <br /> <br />The review process for the new Use Permit included an evaluation of prior uses of the <br />property, extensive community outreach including two. City-facilitated community <br />meetings as well as meetings with neighbors to discuss their concerns regarding the <br />project, and the commissioning of a traffic study. Ongoing monitoring and evaluation of <br />interim measures were also conducted to ensure that these steps would effectively <br />minimize impacts to the students and the neighborhood. Throughout the process staff <br />continued to work with WHCA on defining the scope of the project and related analyses <br />to ensure that the needs of the school as well as the concerns of the community were <br />both addressed. The goal was to obtain a comprehensive and complete Use Permit <br />application (current uses and expanded needs) in order to move the project forward to a <br />public hearing.
