Refer to Attachment 2 for a Page 2 <br />detailed background chronology on the project. <br /> <br />Project Description <br />At the public hearing, WHCA presented the following revised proposal: <br /> <br />. Kindergarten through twelfth grade private school for up to 100 students; <br />. Child care facility for up to 20 children; <br />. The ability to utilize the interior parking lot as a playground for recess, lunch time <br />and other outdoor activities; <br />. Consideration of conceptual plans for the replacement of the existing "Secondary <br />School" classroom building with four (4) modular classrooms; <br />. New signage; <br />. Landscaping improvements; and <br />. Parking lot improvements. <br /> <br />Zoning Administrator Review and Decision <br />The following information was considered by the Zoning Administrator: <br /> <br />. All testimony received at the public hearing; <br />. The information provided in the administrative record; and <br />. The analysis of the project by various staff members. <br /> <br />The Zoning Administrator approved the school with a reduced overall capacity of 80 <br />students and/or childcare spaces to allow the applicant flexibility in operations within a <br />limited overall capacity (230 students were initially proposed, and 120 students were <br />proposed as part of the revised project) based on specific findings. Refer to the Notice <br />of Official Action dated February 9, 2009 for a complete list of findings and conditions <br />(Attachment 3). The Zoning Administrator found it appropriate to include a number of <br />conditions that required additional site improvements as well as follow-up monitoring to <br />ensure long-term compatibility of the use. For example, to address the noise concerns, <br />outdoor playground activities would be prohibited on the parking lot and would be <br />limited to two designated areas on the property which are more sheltered from the <br />neighbors: the "Permanent Playground" and the interior courtyard located between the <br />Church Sanctuary and Fellowship Hall (Attachment 4). The Zoning Administrator <br />determined that adherence to the conditions of approval would ensure that the subject <br />uses, as limited in capacity, would comply with the general welfare of the community. <br /> <br />Appellant's Issues <br />On February 12, 2009, the appellants, Ms. Dawn M. Ward and Ms. MaryAnn Clifford, <br />who live adjacent to the church property on Connecticut Drive, jointly filed an appeal <br />requesting that the City Council overturn the Zoning Administrator's decision thereby <br />denying the WHCA .Use Permit request (Attachment 5). <br /> <br />The appellants cited the following grounds for the appeal: <br /> <br />1. The Use Permit findings were made in error because health, safety and welfare <br />issues would persist: <br />2. The applicant's lack of compliance with regulations and conditions to date; <br />3. The proposed uses are excessive for the neighborhood, causing adverse impacts; <br />4. Concerns regarding noise and outdoor playground activities; and <br />
