<br />80 <br /> <br />. Parking concerns: On-site parking is limited due to the building containing aPage 3 <br />commercial retail space as well as a residential apartment above; <br />. Compatibility: The appellants are of the opinion that, contrary to what is stated in the <br />Notice of Official Action, the adjoining land uses are not compatible in that they are <br />residential and not commercial; <br />. Consistency of use: There is a concern that the use may extend the closing time <br />from 8PM to 10PM in the future; <br />. Safety/Public health: There are existing pedestrian/bicycle/traffic hazards at the <br />intersection; and <br />. (New) General Plan's Guiding Principals: The appellants state that the proposed <br />use does not meet the criteria for "harmonizing with existing development to <br />preserve our neighborhood character", nor does it seem likely, overall, to "improve <br />the health, safety and well being of this neighborhood". The appellants also request <br />that the Council consider imposing a moratorium on approving new massage <br />establishments until a State law (58 731) goes into effect in September 2009. This <br />law will provide minimum thresholds for training individuals who provide massage <br />therapy. The law will require a minimum of 250 hours of training for massage <br />practitioners and a minimum of 500 hours of training will be r~quired for massage <br />therapists. <br /> <br />ALTERNATIVES <br />. Uphold the appeal, thereby overturning the decision of the Zoning Administrator <br />granting the Use Permit request. This action would result in the business not <br />opening at this location. <br /> <br />.
