<br />80 <br />Page 2 <br /> <br />Zoning Administrator Review and Decision <br />The following information was considered by the Zoning Administrator: <br /> <br />. All testimony received at the public hearing; <br />. The information provided in the administrative record; and <br />. Completion of the three-step process for massage establishments. <br /> <br />The Zoning Administrator approved the Use Permit, which is the last step in a 3-step <br />process. The applicant had previously completed steps 1 and 2 with favorable results <br />for massage establishments. The Zoning Administrator, in approving the Use Permit <br />made findings and attached conditions (refer to Attachment 1, the Notice of Official <br />Action dated May 4, 2009, for a complete list of findings and conditions). The three-step <br />process, in sequential order, is outlined as follows: <br /> <br />Step 1: Obtain a Zoning Verification Letter from the Planning Division in writing to <br />confirm that the zoning district is appropriate for the proposed use. The <br />General Commercial-Residential (CG-R) Zoning District allows massage <br />businesses provided that the next-steps are successful. The Zoning Permit <br />Letter was issued to the applicant on November 17, 2008. <br />Step 2: Apply for and obtain all the necessary clearance from the Redwood City Police <br />Department. These clearances include background checks which apply to not <br />only the establishment and business owner, but also all massage technicians <br />who will be employed by the business. The applicant completed the second <br />step and obtained the permits from the Redwood City Police Department on <br />January 27,2009. <br />Step 3: After completing steps 1 and 2, the applicant shall apply for and obtain a Use <br />Permit from the Zoning Administrator. The Use Permit process includes an in- <br />depth analysis of the proposed project from a land use perspective. This <br />review also includes, but is not limited to compatibility with adjoining land uses, <br />hours of operation, adequacy of parking, previous uses on-site, and obtaining <br />neighborhood input at the public hearing. The Use Permit was approved on <br />May 4, 2009. <br /> <br />In addition to the findings, the Zoning Administrator found it appropriate to include a <br />number of conditions that required additional site improvements as well as follow-up <br />monitoring to ensure long-term compatibility of the use. The Zoning Administrator <br />determined that adherence to the conditions of approval would ensure that the subject <br />use would comply with the general welfare of the community. <br /> <br />Appellant's Issues <br />On May 11, 2009, the appellants, consisting of the Redwood Oaks Community <br />Members, jointly filed an appeal requesting that the City Council overturn the Zoning <br />Administrator's decision thereby denying the Use Permit (Attachment 2). <br /> <br />The appellants cited the following grounds for the appeal as summarized below: <br /> <br />. Traffic flow: Traffic on Woodside Road travels above the speed limit and Murray <br />. Court, a narrow residential street, has no sidewalks, storm drains or adequate <br />lighting. The appellants feel that patrons of the proposed business will be circling <br />the neighborhood to find parking; <br />
