<br />:c:..~"'" <br /> <br />.....; <br /> <br />80 <br />Page 5 <br /> <br />This review also includes, but is not limited to compatibility with adjoining land <br />uses, hours of operation, adequacy of parking, previous uses on-site, and <br />obtaining neighborhood input at the public hearing. The public hearing was held <br />by the Zoning Administrator on March 18, 2009 to gather testimony for this <br />project. Prior to the hearing, staff received numerous letters of opposition and at <br />the hearing seven individuals spoke in opposition to the project, based on <br />concerns which related to a lack of on-site parking and when vehicles were <br />parked on-site the vehicles impeded the pedestrian path of travel along the <br />Murray Court right-of-way (due to slack a sidewalk and curb). Concerns also <br />included, but were not limited to potential illegal activity, and patrons of the <br />proposed business potentially parking and/or driving through the adjoining <br />residential streets, as well as the hours of operation. In an effort to address <br />neighborhood concerns, the scope of the use has been reduced from eight <br />therapy rooms to four therapy. rooms. The interior space behind the storefront <br />along Woodside Road is also expected to be active, rather than be used for <br />private rooms with darkened windows, which would result in an inactive <br />storefront. Lastly, the applicant's proposed hours of operation were reduced as a <br />condition of approval from 10AM to 9PM (and extend closing time to potentially <br />10PM at a later date), seven days a week to 10AM to 8PM, seven days a week. <br /> <br />The Zoning Administrator was able to make the following findings and the application for <br />Use Permit was approved, subject to the conditions of approval listed below: <br /> <br />FINDINGS: <br /> <br />1. The establishment, maintenance I and operation of the proposed use will not, <br />under the circumstances of this case, be detrimental to the public health, safety, <br />peace, morals, comfort, or general welfare of persons residing or working in the <br />neighborhood because the strict application of the conditions of approval ensure <br />that the use will be maintained in a clean, attractive condition at all times and the <br />hours of operation are compatible to adjacent commercial uses along the <br />Woodside Road corridor. As previously stated, the scope of the business, <br />namely the number of therapy rooms, staff size and hours of operation, has been <br />reduced to address parking concerns. <br /> <br />2. The establishment and operation of the proposed use will not be detrimental or <br />injurious to property or improvements in the neighborhood because the proposed <br />hours of operation, staff size and other conditions of approval for the business <br />will insure the scale of the project is consistent with other commercial businesses <br />along the Woodside Road corridor and the adjoining residential neighborhood. <br /> <br />3. The establishment and operation of the proposed use will not be detrimental or <br />injurious to the general welfare of the City because the proposed business is <br />considered an amenity and it will offer a service to the residents and visitors of <br />Redwood City consistent with the purpose of the General Commercial Zoning <br />District. <br /> <br />Moreover, the property was constructed in the 19505, under alternative parking <br />requirements.
