NOW, THEREFORE, in order to ensure satisfactory performance by Owner of Owner's obligations under Article VII, Chapter 29, General Street Improvements, of the Code of the City of Redwood City, and in consideration of the approval of the improvements for the Property, the parties hereto agree as follows: 1. IncorDoration of Recitals. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. 2. ImDrovements. Owner shall, at its own cost and expense, construct all of the Improvements, furnish all the materials, and do all the work hereinafter described in accordance with, and as provided for in, the plans prepared for Owner by Triad/Homes Associates Inc., entitled, "Plans for the Improvements of 579 California Way" as well as City's revised specifications entitled, "Engineering Standards of the City of Redwood City", adopted December 4, 2006, which plans and specifications are on file in the office of the City Engineer, Engineering and Construction. Said Improvements shall also be constructed in strict compliance with the provisions of Article VII, Chapter 29 of the Code of the City of Redwood City. If a conflict exists between the plans and specifications and said Chapter 29 in regard to the standard for a particular improvement, the stricter standard shall govern to the extent of such conflict. Owner shall complete all of the Improvements, subject to such exceptions and time extensions allowable under paragraph 10, on or before November 1, 2009.
